134 <br />Regular Meeting August 15, 2006 Page 11 <br />very tough decision for him. He stated he felt he would not be able to <br />meet his own expectation as a Professor and as a Council Member. He stated <br />he knows this is a surprise, but he will be able to serve until the <br />election in November. Mayor Narvaiz stated Mr. Mihalkanin is instrumental <br />on the City Council with his knowledge of the history of San Marcos. She <br />stated he has given so much service and time to the citizens of San Marcos <br />and to the City. She stated it is an honor to serve with Mr. Mihalkanin <br />and she appreciated everything he has done. Mr. Jones thanked Mr. <br />Mihalkanin for stepping up and doing more than other Professors by serving <br />on the Council. He also thanked Mr. Mihalkanin for being his mentor. Mr. <br />Guerrero stated he has sat next to Mr. Mihalkanin for two years and learned <br />from him. He thanked Mr. Mihalkanin for his service on the Council. The <br />Council then voted unanimously for approval to accept the resignation of <br />Council Member, Place One, Ed Mihalkanin, effective upon his successor <br />being duly qualified. <br />Mayor Narvaiz introduced for consideration adoption of an Ordinance on <br />emergency the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ORDERING A GENERAL AND SPECIAL ELECTION TO BE HELD ON NOVEMBER 7, 2006 <br />FOR THE PURPOSE OF ELECTING A MAYOR, CITY COUNCIL MEMBER, PLACE 5, A <br />CITY COUNCIL MEMBER, PLACE 6, A CITY COUNCIL MEMBER, PLACE 1 TO FILL A <br />VACANCY IN THAT POSITION, FOR THE REMAINDER OF THE TERM OF OFFICE FOR <br />THAT POSITION; AND TO SUBMIT PROPOSITIONS TO THE VOTERS FOR PROPOSED <br />AMENDMENTS TO THE CITY CHARTER; ESTABLISHING EARLY VOTING LOCATIONS <br />AND POLLING PLACES FOR THIS ELECTION; MAKING PROVISIONS FOR THE <br />CONDUCT OF THE ELECTION; AND DECLARING AN EMERGENCY. <br />Mr. Thomaides moved for adoption of the Ordinance on emergency, and Mr. <br />Bose seconded the motion. Mr. Mihalkanin inquired to Section 6.03 of <br />Measure 12. Mr. Taylor stated if the voters approve Measure 12 it would <br />eliminate the duplication and conflicts with State Law in the City Charter. <br />Mr. Mihalkanin inquired about Section 3.11 of Measure 8. Mr. Taylor stated <br />this Measure would allow an Ordinance amending the future land use map to <br />be adopted in the same manner as zoning amendments and to allow Ordinances <br />to be adopted under procedures authorized by State Law. Mr. Mihalkanin <br />moved to remove Measure No. 5 Section 3.02 of the City Charter to change <br />the minimum age of Council Members from 18 to 21, and Mr. Diaz seconded the <br />motion. Mayor Narvaiz stated she supports the deletion of the minimum age <br />requirement. Mr. Thomaides stated he has received a lot of community <br />feedback regarding the minimum age requirement. He stated he feels the <br />goals of the community should be to work together. He stated normally he <br />would support the Charter Review Commission's recommendation, but not on <br />this issue. Mr. Guerrero stated he feels the voters should have the final <br />say on the minimum age requirement. Mr. Jones stated he feels this would <br />be an opportunity for the voters to decide on the minimum age requirement <br />once and for all. He stated he feels this Measure is unfair. Mr.
