Regular Meeting December 4, 2006 Page 6 completed the preliminary design phase of the Rio Vista Terrace Subdivision Public Improvements project. The construction plan includes replacement of I water, wastewater, and drainage systems, as well as the reconstruction of streets and sidewalks throughout the neighborhood. She stated the design has been further identified, a cost for final design services has been established. Mr. Thomaides inquired to when the project will begin. Ms. Anderson stated the City will review the plan by March and the project should begin in the summer of 2007. The Council then voted unanimously for approval of Change in Services No, 2 in the amount of $287,680.00 related to the Final Design of the Rio Vista Terrance Subdivision Reconstruction Project with Bryn & Associates. Mayor Narvaiz introduced a public hearing to accept citizen comments on the program year 2005 Community Development Block Grant Consolidated Annual Performance and Evaluation Report (CAPER). Mayor Narvaiz opened the public hearing and asked if anyone wished to speak. No one did, so Mayor Narvaiz closed the public hearing. Mayor Narvaiz introduced approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 269.58 ACRES, MORE OR I LESS, LOCATED SOUTHWEST OF THE INTERSECTION OF MACARTY AND HUNTER ROADS (HILLTOP TRACT); APPROVING A SERVICE PLAN FOR THIS TRACT; AND INCLUDING PROCEDURAL PROVISIONS. Mr. Bose moved for approval of an Ordinance on first reading, and Mr. Guerrero seconded the motion. Mr. Bose inquired to whether this property is owned by First Baptist Church. Mr. O'Leary stated this property is not owned by the Baptist Church. Ms. Robertson stated she is concerned with annexing all areas around a particular area. Mr. O'Leary stated the City is surrounding the area which the City annexed once annexed and then disannexed. The Council then voted unanimously for the approval of the Ordinance on first reading. Mayor Narvaiz introduced approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING THE RELEASE AND CONVEYANCE OF AN ELECTRCAL EASEMENT ACROSS PROPERTY LOCATED NEAR THE INTERSECTION OF WONDER WORLD DRIVE AND IH 35 SOUTH; AUTHORIZING THE CITY MANAGER TO EXECUTE THE RELEASE AND CONVEYANCE; AND DECLARING AN EFFECTIVE DATE. I Mr. Guerrero moved for approval of an Ordinance on first reading, and Mr. Jones seconded the motion, which passed unanimously.
