AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP FROM MEDIUM DENSITY RESIDENTIAL TO MIXED USE FOR A 1.339 ACRE, MORE OR LESS, TRACT OF LAND LOCATED AT 324 LINDA DRIVE; AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING THIS TRACT FROM "MH" MANUFACTURED HOME DISTRICT TO "MU" MIXED USE DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Mayor Narvaiz introduced for consideration a reconsideration of Zoning Ordinance, which read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP FROM INDUSTRIAL TO COMMERCIAL FOR A 3.1 ACRE, MORE OR LESS, TRACT OF LAND LOCATED AT 2030 IH-35 SOUTH; AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING THIS TRACT FROM "HI" HEAVY INDUSTRIAL DISTRICT TO "GC" GENERAL COMMERCIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. I Mr. Jones moved to reconsider the Zoning Ordinance, and Mr. Thomaides seconded the motion, which passed unanimously. Mr. Jones moved for adoption of the Zoning Ordinance, and Ms. Couch seconded the motion. Mr. Jones inquired as to the purpose of this zoning. Carol Barrett, Director of Planning Development, stated this property was changed to the Manufactured Home zoning district and Medium Density Residential designation from Commercial designations during the 2005 citywide rezoning. This was done in accordance with policy that zoning be changed to match land use policy and built conditions. She stated the owner has been marketing the property as Mixed Use and requested that his property be rezoned to an equivalent zoning as was previously applied to the site. Mr. Jones inquired to the amount of acreage remaining in the Industrial Zone along IH35. Ms. Barrett stated there is not allot of acreage left in the Industrial Zoning in South San Marcos that has access to IH35. The Council then voted unanimously for the adoption of the Zoning Ordinance.
