ORDINANCE N0.2007- 57 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MAROCS, TEXAS, REPEALING A PLANNED DEVELOPMENT DISTRICT <br />OVERLAY FOR 239.4 ACRES, MORE OR LESS, IN THE WILLIAM WARD <br />SURVEY, KNOWN AS THE BLANCO RIVERWALK SUBDIVISION; <br />APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP <br />FROM "HDR" HIGH DENSITY RESIDENTIAL TO "MU" MIXED USE, FOR <br />A 15.065 ACRE, MORE OR LESS, TRACT OF LAND LOCATED IN THE <br />BLANCO RIVERWALK SUBDIVISION AT THE 2700 BLOCK OF IH-35 <br />NORTH; FOR AMENDING THE OFFICIAL ZONING MAP OF THE CITY <br />BY REZONING THIS TRACT FROM "MF-24" MULTI-FAMILY DISTRICT <br />TO "MU" MIXED USE DISTRICT; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br />RECITALS <br />1. On September 11, 2007, the City Planning and Zoning Commission of the City of San <br />Marcos held public hearings regarding a request to repeal a planned development district overlay <br />("PDD") for 239.4 acres, more or less, of land in the William Ward Survey, known as the Blanco <br />Riverwalk Subdivision. Subsequent to the public hearings the Planning Commission voted to <br />recommend approval of the repeal, subject to inclusion on the plat notes concerning low impact <br />drainage standards that would be part of the covenants, conditions and restrictions placed on <br />property owners and enforced through a property owner's association. The repeal was also <br />dependant on a continuation of the promise to donate, to the City, 57 acres of land for a park. <br />2. Subsequent to the repeal of the PDD, the Planning Commission held public hearing <br />concerning a request to change the Future Land Use Map of the San Marcos Horizons City <br />Master Plan from "HDR" High Density Residential to "MU" Mixed Use and a concurrent <br />request to change the zoning from "MF-24" Multi Family District to "MU" Mixed Use District <br />fora 15.065 acre, more or less, tract of land located in the Blanco Riverwalk Subdivision at the <br />2100 Block of IH 3 5 North. <br />3. Subsequent to the public hearings on that date, the Planning and Zoning Commission <br />considered and voted to approve the requests on September 1 1, 2007, and recommended that the <br />requests be approved by the City Council. <br />4. The City Council held a public hearing on October 2, 2007 ,regarding the <br />requests. <br />5. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />6. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />
