BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS SECTION 1. The repeal of the Planned Development District Overlay for the 239.4 acre, more or less, piece of property known as the Blanco Riverwalk Subdivision is approved, subject to the conditions set forth in Recital 1, above and the Declarations, Covenants and Restrictions filed in Volume 2342, Page 486 of the Hays County Official Public Records and attached hereto as Exhibit "A." SECTION 2. The Agreement with regard to the donation and upkeep of 57 acres of parkland, attached hereto as Exhibit "B" is approved. SECTION 3 . The City Manager, Dan 0' Leary is authorized to execute the Agreement for Parkland on behalf of the City. SECTION 4. The Future Land Use Plan of the San 1Vlarcos Horizons City lvlaster Plan is revised to change the future land use designation from "HDR" High Density Residential to "MU" Mixed Use: Street address: 2100 Block IH-35 North. Size: 15.065 acres, more or less Legal Description: See, attached Exhibit "C" Deed reference: Volume 2555, page 250 of the Hays County Official Public Records. SECTION 5. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the City Land Development Code, is amended to rezone the tract of property described in Section 1 above from "MF-24" Multi Family District to "MU" Mixed Use District SECTION 6. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 7. After its original passage, this ordinance will be subject to reconsideration at the next regular City Council Meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, notice of its adoption will be published in a newspaper of general circulation in the City. This ordinance will take effect upon publication of this notice.
