Sec. 8.17, Purchase procedure, should be amended to delete the <br />specific dollar amounts contained in the provision a~d <br />substitute the followinq phrase for those dollar provisions: <br /> <br />"...The Council may by ordinance convey upon the City Manager <br />general authority to contract for expenditures without further <br />approval of the Council for all budgeted items not exceeding ?Tve <br />~~r~-~~.~~ the maximum allowed by State law. <br />All contracts for expenditures involving more than ~~ <br />~r~~~~.~r the maximum allowed by State law shall be let to <br />the lowest and best responsible bidder after there has been <br />opportunity for competitive bidding as provided for by law or <br />ordinance; provided that the City shall have the right to reject <br />any and all bids...." <br /> <br />JUSTIFICATION: <br /> <br />The legislature has changed the State law dealing with limitations <br />on purchases by cities. The changes suggested above by the Charter <br />Review Commission will eliminate the continuous changing of the <br />City Charter each time the legislature makes a chanGe but the <br />recommendation does not reduce in any way the power and control <br />over such purchases by the City Council. This provision only <br />allows the City Council more flexibility in dealing with <br />purchases through the City Manager. . <br /> <br />15. Sec. 10.08, Tax remissions, discounts, and compromises, <br />amended as indicated by following underlined phrase: <br /> <br />should <br /> <br />be <br /> <br />"The City Councilor any other official of the City shall never <br />extend the time for the payment of taxes or remit, discount or <br />compromise any tax legally due the City or waive the penalty and <br />interest that may be due thereon to any persons, firms or <br />corporations owing taxes to the City for such year or years <br />except as Dermitted by State law: provided, however, that this <br />provision shall not prevent the compromise of any tax suit." <br /> <br />JUSTIFICATION: <br /> <br />As presently written, all types of tax abatement may be precluded <br />by this section of the Charter. This addition will prevent any <br />argument about whether the City can take advantage of any tax <br />abatement provision that is permitted by Statè law. <br /> <br />16. Sec. 11.02, Power to grant franchise, should be amended by striking <br />the words "by mutual agreement,". <br /> <br />JUSTIFICATION: <br /> <br />This amendment eliminates ambiguity about what word is modified by <br />the deleted phrase. The phrase is unnecessary to protect <br />franchisee's interests since most franchises are made by agreement. <br />
