are State agencies or units of local government; and certain additional provisions will apply to such <br />Contractors. <br />a) The following sections or portions of sections of these General Provisions will not apply to <br />interagency or interlocal contracts: <br />1) Hold Harmless and Indemnification, Section 13.19; <br />2) Independent Contractor, Section 12.15 (delete the third sentence in its entirety; delete the <br />word "employees" in the fourth sentence; the remainder of the section applies); <br />3) Insurance, Section 12.03; <br />4) Liability Coverage, Section 12.05; <br />5) Fidelity Bond, Section 12.04; <br />6) Historically Underutilized Businesses, Section 12.10 (Contractor, however, shall comply <br />with HUB requirements of other statutes and rules specifically applicable to that entity); <br />7) Debt to State and Corporate Status, Section 3.01; <br />8) Application of Payment Due, Section 3.02; and <br />9) Article XV Claims against the Department (This Article is inapplicable to interagency <br />contracts only). <br />b) The following additional provisions will apply to interagency contracts: <br />1) This Contract is entered into pursuant to the authority granted and in compliance with the <br />provisions of the Interagency Cooperation Act, Tex. Gov. Code Chapter 771; <br />2) The Parties hereby certify that (1) the services specified are necessary and essential for the <br />activities that are properly within the statutory functions and programs of the affected <br />agencies of State government; (2) the proposed arrangements serve the interest of efficient <br />and economical administration of the State government; and (3) the services, supplies or <br />materials contracted for are not required by Section 21 of Article 16 of the Constitution of <br />the State of Texas to be supplied under contract given to the lowest responsible bidder; <br />and <br />3) DSHS certifies that it has the authority to enter into this Contract granted in Tex. Health & <br />Safety Code Chapter 1001, and Contractor certifies that it has specific statutory authority <br />to enter into and perform this Contract. <br />c) The following additional provisions will apply to interlocal contracts: <br />1) This Contract is entered into pursuant to the authority granted and in compliance with the <br />provisions of the Interlocal Cooperation Act, Tex. Gov. Code Chapter 791; <br />2) Payments made by DSHS to Contractor will be from current revenues available to DSHS; <br />and <br />3) Each Party represents that it has been authorized to enter into this Contract. <br />d) Contractor agrees that Contract Revision Requests (pursuant to the Contractor's Request for <br />Revision to Certain Contract Provisions section), when signed by a duly authorized <br />representative of Contractor, will be effective as of the effective date specified by the <br />Department, whether that date is prior to or after the date of any ratification by Contractor's <br />governing body. <br />Section 2.09 Civil Rights Policies and Complaints. <br />Upon request, Contactor shall provide the Health and Human Services Commission (HHSC) Civil <br />Rights Office with copies of all Contractor's civil rights policies and procedures. Contractor shall <br />notify HHSC's Office of Civil Rights of any civil rights complaints received relating to performance <br />General Provisions (Core Subrecipient) 2015 (July 1, 2014) 9 <br />
