Failure to obtain or <br />any revocation, surrender, expiration, non - renewal, inactivation or suspension of any such license, <br />certification, permit, registration or approval constitutes grounds for termination of this Contract or <br />other remedies the Department deems appropriate. Contractor shall ensure that all its employees, <br />staff and volunteers obtain and maintain in active status all licenses, certifications, permits, <br />registrations and approvals required to perform their duties under this Contract and shall prohibit any <br />person who does not hold a current, active required license, certification, permit, registration or <br />approval from performing services under this Contract. <br />Section 2.11 Funding Obligation. <br />This Contract is contingent upon the availability of funding. If funds become unavailable through <br />lack of appropriations, budget cuts, transfer of funds between programs or health and human services <br />agencies, amendment of the Appropriations Act, health and human services agency consolidation, or <br />any other disruptions of current appropriated funding for this Contract, DSHS may restrict, reduce or <br />terminate funding under this Contract. Notice of any restriction or reduction will include instructions <br />and detailed information on how DSHS will fund the services and /or goods to be procured with the <br />restricted or reduced funds. <br />Section 2.12 Whistleblower Protection. <br />Contractor shall include the Whistleblower Protection Enhancement Act and Texas Whistleblower <br />Act protections to grantees, their subgrantees and subcontractors and Contractor must inform its <br />employees of whistleblower rights and remedies. <br />Section 2.13 Federal Assistance Identification Number. <br />Contractor shall include the Federal Assistance Identification Number (FAIN) on each subaward <br />under a Federal award to enable reporting of expenditures according to the FAIN.
