<br />PROFESSIONAL ENGINEERING SERVICES AGREEMENT <br /> <br />This Agreement is made this the 5h day of November, 2007, between the City of San <br />Marcos, Texas ("CIty"), 630 East Hopkins, San Marcos, Texas 78666 and CH2M Hill, Inc. <br />("Engineer"), 12301 Research Boulevard, Building 4, Suite 250, Austin, Texas 78759 for the <br />provIsion of professional engineering services in connectIon with the Waste Water Treatment <br />Plant ("WWTP") Wet Weather Improvements Project (the "ProJect"). <br /> <br />The CIty and the Engineer agree as follows: <br /> <br />ARTICLE 1 <br />ENGINEER'S SERVICES AND RESPONSIBILITIES <br /> <br />1.1 STANDARDS OF PERFORMANCE <br /> <br />1.1.1 Engineer will be responsible for the proper, accurate and adequate design and <br />preparation of plans and specificatIons and other construction contract documents and for <br />construction management of the ProJect. The Project generally consists of the following: <br /> <br />a) Expansion of the WWTP activated sludge and secondary clarifier process unIts to <br />treat 9.0 mgd maximum month flows; <br /> <br />b) Expansion of the grit removal system to treat projected future peak flows of 31 <br />mgd. ; <br /> <br />c) Installation of three separate emergency power generators to serve Master Control <br />Cabinets MCC-100, MCC-400 and MCC-A; <br /> <br />d) Miscellaneous improvements including Installation of a grounding grid as <br />recommended in the WWTP GroundIng and Lightning ProtectIon Technical <br />Memorandum of May 2006, installation of surge protection as recommended In <br />the report Surge Protection Assessment of May 2006, and replacement of the <br />secondary clarifier scum removal systems, and InstallatIon of a rear door In the <br />Dewatering Building for truck loading activities; and <br /> <br />e) Assessments of the existing UV dIsinfectIon system, the re-aeration system, reuse <br />pumping system, and aeration basin system piping. <br /> <br />1.1.2 The Engineer's Basic Services consist of the services described in Sections 1.1 through <br />1.7 and include normal civil engineering services. <br /> <br />1.1.3 The performance of all services by the Engineer in connection with this Agreement will <br />be by persons appropriately licensed or registered under State, local and Federal laws governing <br />their respective consulting diSCIplines. In performing all servlces under this Agreement, the <br />Engineer WIll use that degree of care and skill ordinarily exercised for similar projects by <br />professional consultants who possess special expertise in the types of services involved under <br />this Agreement. <br /> <br />Wet Weather Improvements Project - CH2M Hill <br /> <br />1 <br />
