from the date of receipt of bids and the Engineer will provide a written recommendatIon for award of bid within 10 calendar days after receipt of the bid documents. 1.6.7 Have no authority to Issue a Notice to Proceed to any Contractor. 1.7 TASK 6 - CONSTRUCTION ADMINISTRATION The Construction phase of this ProJect wIll commence with the award of the construction contract and will terminate when the Project is accepted by the City. The Engineer will: 1.7.1 Provide servIces dunng constructIon ("SDC") to assIst the City in coordinating the sIte activitIes, admInistering the constructIon contract, monItoring the contractor's performance, verifying that the Contractor's work is in substantial compliance wIth the contract documents, responding to design and technical submittals, responding to events that occur during the construction and closing out the contract for construction all as set forth In the construction contract documents unless othenvise provided in thIS Agreement and incorporated in the constructIon contract documents. These SDC are based upon the understandIng that the CIty will contract directly WIth the Contractor, and will be involved In the construction process to make deciSIons with assistance from the Engineer, provide approvals and perform other actions necessary for the completIon of the construction. These SDC are also based upon the CIty executing a contract for construction with the Contractor that is as consistent as possible with thIS Agreement and with these SDC, and which provides the reqUIsite authority for the Engineer to fulfill its SDC responsibilities. 1.7.2 Be a representative but not an agent of the City during the construction phase, and adVIse and consult with the City and provide progress reports and advice to the City in writing; forward the City's instructions to the Contractor unless (1) EngIneer is unavailable by telephonic communicatIon or otherwise to Issue instructions necessary for the proper progress and acceptance of work; (2) jeopardy to life and/or property exists~ and/or (3) lack of instructions and/or unavailabIlity of Engineer will result in, in City's opinion, harm to City, In whIch case instructions may be forwarded dIrectly to the Contractor by the City; have authonty to act on behalf of the CIty only to the extent provided herein and in the construction contract documents unless otherwIse modIfied by wntten Instrument in accordance with SectIon 12.1. Any instructions issued dIrectly by CIty to Contractor will be promptly communicated to the Engineer if the Engineer was unavailable at the time of issuance of instructions. 1.7.3 Assist the City in conducting a pre-construction conference with the Contractor, members of City's staff, representatives of affected utility providers, and federal and state agencies haVIng jurisdIctIon over the ProJect (including City inspectors) in order to review Project coordination, required procedures, the Contractor's general work plan, construction schedule, requirements for the Project and to identify key representatives of the parties and lines of communication. The Engineer will take minutes or otherwise record the results of this conference. 1.7.4 Assist the City in ensuring that all applicable permIts and approvals have been obtained by the Contractor from the appropriate agencies prior to construction.
