<br />I <br /> <br />ORDINANCE 2007- 63 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS. TEXAS, CANVASSING RETURNS AND DECLARING RESULTS <br />OF THE GENERAL AND SPECIAL ELECTION, HELD ON NOVEMBER 6, <br />2007, FOR THE PURPOSE OF ELECTING CITY COUNCIL MEMBERS, <br />PLACES 1 AND 2, AND TO CONSIDER A PROPOSITION TO INCREASE <br />THE HOTEL OCCUPANCY TAX FROM SEVEN PERCENT (7%) TO NINE <br />PERCENT (9%) TO ESTABLISH AND FUND THE SAN MARCOS <br />CONFERENCE CENTER AS A VENUE PROJECT; AND DECLARING AN <br />EMERGENCY. <br /> <br />RECITALS: <br /> <br />1. On August 6, 2007 the City Council ordered that a General and Special Election be held <br />on November 6, 2007 for the purpose of electing City Council Members, Places 1 and 2 and to <br />consider a proposition to increase the hotel occupancy tax from seven percent (7%) to nine <br />percent (9%) to establish and fund the San Marcos Conference Center as a venue project <br /> <br />2. Notice of this election was duly published in the San Marcos Daily Record. <br /> <br />3. A copy of the notice was posted on the bulletin board at City Hall. <br /> <br />I <br /> <br />4. This election was duly and legally held on November 6, 2007, in conformity with the <br />election laws of the State of Texas, and the results of the election have been certified and <br />returned by the proper judges and clerks. <br /> <br />5. The City Council of the City of San Marcos, Texas with the following members present: <br />Susan Narvaiz Daniel Guerrero Gavlord Bose <br />Tohn Thomairles Pam Couch Betsy Rohertson <br />and Chris Jones have today considered the returns of the General election held <br />on November 6,2007. <br /> <br />6. It appears to the Council, and Council finds, that the tabulation of the results of the <br />election is correct. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The General and Special Election of November 6, 2007 was duly called, <br />notice of the election was given in accordance with law, and the election was conducted in <br />accordance with law. <br /> <br />I <br /> <br />SECTION 2.
