<br />Work Responsibilities <br /> <br />1. Environmental Requirements <br /> <br />A. The Local Government shall be responsible for identification of all environmental issues associated <br />with this project and shall be responsible for preparation of the appropriate environmental <br />documentation necessary to secure environmental clearance for the Project. Preparation and <br />coordination of the environmental documentation shall be through the TxDOT Austin District <br />Environmental Coordinator at (512) 832-7168 <br /> <br />B To the extent required to complete the Project, the Local Government will be responsible for the <br />mitigation and remediation of any environmental problems associated with the development of the <br />Project. All costs associated with the remediation of the environmental problems will be the <br />responsibility of the Local Government. <br /> <br />C The Local Government shall provide to the State written documentation from the appropriate <br />regulatory agency(s) that all environmental clearances have been obtained, prior to the State <br />advertising for bids <br /> <br />2. Engineering Services <br /> <br />A. The Local Government shall prepare or cause to be prepared the engineering plans, specifications, <br />and estimates (P S & E.) necessary for the development of the Project. The P S & E. shall be <br />prepared in accordance with all applicable laws, policies and regulations, deemed necessary by the <br />State <br /> <br />B The engineering plans shall be developed in accordance with the Texas Department of Transportation <br />Roadway Design Manual, the current edition of the Standard Specifications for Construction and <br />Maintenance of Highways, Streets, and Bridges and the Texas Accessibility Standards <br /> <br />C The Local Government shall submit the completed P S & E. to the State for review and approval <br />twenty weeks prior to the State's anticipated bid opening date Should the State determine that <br />revisions are required to the documents the Local Government shall make the necessary revisions, in <br />accordance with the required dates as outlined in the State's current PS&E Review and Processing <br />Schedule <br /> <br />3. Utilities <br /> <br />The Local Government shall be responsible for the adjustment, removal, or relocation of utility facilities for the defined <br />work in accordance with applicable State laws, regulations, rules, policies, and procedures, including any cost to the <br />State of a delay resulting from the Local Government's failure to ensure that utility facilities are adjusted, removed, or <br />relocated before the scheduled beginning of construction The Local Government must obtain advance approval for <br />any variance from established procedures The Local Government shall provide a certification stating that the Local <br />Government has completed the adjustment of all utilities that must be adjusted before construction is completed <br /> <br />4. Construction Responsibilities <br /> <br />A. The State shall advertise for construction bids, issue bid proposals, receives and tabulate the bids and <br />award and administer the contract for construction of the Project. Administration of the contract <br />includes the responsibility for construction engineering and for issuance of any change orders, <br />supplemental agreements, amendments, or additional work orders, which may become necessary <br />subsequent to the award of the construction contract. <br />B The State will use its approved contract letting and award procedures to let and award the <br />construction contract. At its option, the State may submit the Project for pricing and execution as a <br />change order into a currently active State let roadway improvement project. <br />C The State will award the contract up to a cost equal to 20% over the Latest Engineers Estimate The <br />Local Government shall be responsible for 100% of the construction costs of any contract so awarded <br /> <br />Page 3 of 3 <br />
