<br />55 <br /> <br />Regular Meeting <br /> <br />April 25, 1988 <br /> <br />Page 4 <br /> <br />Mr. Farr moved for adoption of the Ordinance on emergency and Ms. <br />Kissler seconded the motion. Mr. Gonzalez stated the net effect <br />of the amendment would be to lower apartments and increase restaur- <br />ants. There was a discussion of a retroactive date. Mr. Guerra <br />moved to amend to add Section 5 as follows: "The purpose of this <br />legislation is remedial, therefore, this Ordinance shall be applied <br />retroactively and be in full force and effect from and after January 1, <br />1987," and Ms. Kissler seconded the motion, which passed unanimously. <br />A representative of Village on the River stated they would like to <br />have a reduction in the fee. Ms. Kissler moved to amend the Ordinance <br />to be on first reading rather than on emergency and Mr. Farr seconded <br />the motion, which passed unanimously. The Council then voted unanimously <br />for approval of the Ordinance on first reading, as amended. <br /> <br />Mayor Younger introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE FOLLOWING SECTIONS OF <br />CHAPTER 30, ARTICLE II, DIVISION 4, SEWAGE SYSTEM <br />CAPITAL RECOVERY FEE: SECTION 30-41 TO REDEFINE <br />"LUEII; SECTION 30-44 TO REDEFINE "LUEII; SECTION <br />30-45 TO BREAK DOWN THE LUE COMPUTATION FOR RESIDEN- <br />TIAL USES INTO TWO (2) CATEGORIES, TO AMEND THE LUE <br />COMPUTATION FOR RESTAURANT/BAR, FOR HQTEL/MOTELS WITH <br />RESTAURANT AND/OR BAR, FOR LAUNDROMATS, AND FOR CAR <br />WASHES, TO DELETE THE REFERENCES UNDER "HOTEL/MOTELS <br />WITH RESTAURANT AND/OR BAR" AND IIRESTAURANT/BARII WITH <br />RESPECT TO THE ASSESSMENT OF AN ADDITIONAL ANNUAL FEE, <br />TO DELETE THE REFERENCE UNDER IIINDUSTRIALII TO ANNUAL <br />INCREASE ADJUSTMENTS IN THE CRFN, TO ADD PROVISIONS <br />FOR REASSESSMENT OF ANNUAL USAGE FEES FOR ALL NON- <br />RESIDENTIAL USES FOR A FIVE (5) YEAR PERIOD, TO AMEND <br />TERMS IN THE FORMULA USED FOR CALCULATION OF THE ANNUAL <br />USAGE FEES; SECTION 30-48 TO REDEFINE LUEEC; AND DECLAR- <br />ING AN EMERGENCY. <br /> <br />Mr. Farr moved to amend the Ordinance to approve the Ordinance on first <br />reading rather than adopt the Ordinance on emergency and to amend the <br />Ordinance to add Section 5. as follows: liThe purpose of this legis la- <br />t~on is remedial, therefore, this Ordinance shall be applied retro- <br />actively and be in full force and effect from and after January 1, <br />1987," and Mr. Guerra seconded the motion, which passed unanimously. <br /> <br />Mayor Younger introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ADDING A NEW SECTION 5-32 TO DIVISION <br />2 OF ARTICLE II OF CHAPTER 5 OF THE CODE OF ORDINANCES <br />OF SAID CITY TO AMEND THE 1985 EDITION OF THE STANDARD <br />BUILDING CODE TO ADOPT CERTAIN SAFETY REQUIREMENTS FOR <br />ALL CONSTRUCTION PROJECTS WITHIN SAID CITY AND ITS ETJ, <br />RENUMBERING SEQUENTIALLY THE REMAINING SECTIONS OF <br />SAID ARTICLE AND THE FOLLOWING SECTIONS OF ARTICLE <br />III OF SAID CHAPTER OF SAID CODE AND DECLARING AN EF- <br />FECTIVE DATE. <br /> <br />Ms. Kissler moved for approval of the Ordinance on first reading and <br />Mr. Brown seconded the motion. Mayor Younger moved to amend the Ordin- <br />ance to delete from Section 2101.9.5 the following wording: "or within <br />the extraterritorial jurisdiction,1I and in the caption "AND ITS ETJII <br />and Mr. Farr seconded the motion, which passed unanimously. The Council <br />then voted unanimously for approval of the Ordinance on first reading. <br />
