<br />142 <br /> <br />Regular Meeting <br /> <br />June 27, 1988 <br /> <br />Page 3 <br /> <br />Mr. Moore moved for adoption of the Ordinance on emergency and Mr. <br />Plummer seconded the motion. Mr. Guerra stated he was opposed to <br />considering the Ordinance on emergency. Jack Mutschlechner stated <br />six cities were contacted regarding the writing of the specs for <br />the firetruck. The Committee determined to write the specs for a <br />75' truck because we could not afford the 100' truck, and the Com- <br />mittee also felt the 75' truck would be more maneuverable. Dean <br />Shumaker of Sutphen stated if the Council needed more than 45 days, <br />his company was willing to extend that to 60 days. Mayor Morris <br />stated she felt strongly about the Ordinance being adopted now. <br />The Council voted unanimously for adoption of the Ordinance on <br />emergency. <br /> <br />The Council moved Item 8.A. on the agenda to this point, award of <br />bid on a custom pumper/aerial device firetruck. Mr. Plummer moved <br />to award bid to Sutphen Corporation in the amount of $328,876.00, <br />contingent upon a successful negotiation of a $9,500.00 discount, <br />with the City making a down payment of $75,000.00 and the manufacturer <br />to provide the City with a performance bond in the amount of $320,376.00, <br />and Mr. Hernandez seconded the motion, which passed unanimously. <br /> <br />The Council returned to Item 6.A. on the Agenda. Mayor Morris intro- <br />duced for consideration approval of an Ordinance on first reading, <br />the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, REPEALI~G ORDINANCE NO. 1988-7, WHICH <br />CREATED A MUNICIPAL COURT OF RECORD, UNTIL FURTHER <br />. . <br />ACTION OF THE CITY COUNCIL AND DECLARING AN EFFECT- <br />IVE DATE. <br /> <br />Mr. Moore moved for approval of the Ordinance on first reading and <br />Mr. Guerra seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 12 OF THE SAN MAR- <br />COS CODE OF ORDINANCES BY THE ADDITION OF A REQUIRE- <br />MENT FOR GARBAGE CONTAINERS OF PRIVATE GARBAGE SERVICE <br />IN ALL MULTI-FAMILY BUILDINGS HAVING FOUR (4) OR MORE <br />UNITS; ALLOWING SIXTY (60) DAYS FOR COMPLIANCE BY EXIST- <br />ING MULTI-FAMILY UNITS; AND ESTABLISHING AN EFFECTIVE <br />DATE. <br /> <br />Mr. Moore moved for approval of the Ordinance on first reading and <br />Mr. Hernandez seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 21, ARTICLE 5 OF THE <br />CODE OF ORDINANCES CONCERNING POLICE OFFICERS SPECIAL <br />ASSIGNMENT SERVICES TO CHANGE THE AMOUNTS CHARGED FOR <br />SUCH SERVICES AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for approval of the Ordinance on first reading and <br />Mr. Plummer seconded the motion, which passed unanimously. <br /> <br />Mayor Moore introduced for consideration approval of minutes, adop- <br />tion of three Ordinances on third and final reading and adoption <br />of three Resolutions on consensus. The Council pulled Item 7.C. (2) <br />from consensus. Mr. Guerra moved for approval of the minutes of the <br />
