<br />141 <br /> <br />Regular Meeting <br /> <br />June 27, 1988 <br /> <br />Page 2 <br /> <br />Mayor Morris opened the public hearing and asked if anyone wished <br />to speak in favor or in opposition to the Ordinance amendment. <br />Dan Gibson of the Planning Department advised the Council this <br />Ordinance eliminates PUDs. No one wished to speak, so Mayor <br />Morris closed the public hearing. Mr. Moore moved to delete <br />Section 705.9.-26. and to renumber the remaining sections following <br />that section, and Mr. Plummer seconded the motion, which passed <br />unanimously. The Council then voted unanimously for approval of <br />the Ordinance on first reading. <br /> <br />Mayor Morris introduced for consideration a public hearing and ap- <br />proval of the Ordinance on first reading, the caption which was read <br />as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE GENERAL ZONING ORDINANCE <br />OF THE SAN MARCOS CODE OF ORDINANCES BY CORRECTING <br />AN ERROR IN SECTION 37(B) (1) (a) OFF-STREET PARKING <br />BY PROVIDING FOR SEQUENTIAL NUMBERING IN SECTION 4, <br />DEFINITIONS, AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />Mayor Morris opened the public hearing and asked if anyone wished <br />to speak in favor or in opposition to the amendment. No one did, <br />so Mayor Morris closed the public hearing. Mr. Hernandez moved to <br />approve the Ordinance on first reading and Mr. Plummer seconded <br />the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration a public hearing and ap- <br />proval of an Ordinance on first reading, the caption which was read <br />as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING APPENDIX C, SUBDIVISIONS, OF <br />THE SAN MARCOS CODE OF ORDINANCES BY THE ADDITION OF <br />AETICLE VI.F. PROVIDING DETAILED WATER SYSTEM REGULA- <br />TIONS, AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak in favor or in opposition to the amendment. John Bell, an at- <br />torney representing Elim Water Company, stated they were in support <br />of the amendment except in Part 2., Section F., 4.c. He stated it <br />was a mistake to vary from the Legislature's method of how to purchase <br />a water system. He stated the contract is not attached to this Ordin- <br />ance and therefore provides no flexibility. Mr. Gonzalez stated he <br />does think the Ordinance provides flexibility. Mr. Hankins stated <br />the second paragraph in that section could be deleted, and Mr. Gon. <br />zalez stated another water company had requested that language be <br />included. No one else wished to speak, so Mayor Morris closed the <br />public hearing. Mr. Moore moved to amend the Ordinance in Part 2., <br />Section F., 4.c. to add the following language: "This shall be ar- <br />ranged by a mutually acceptable contract. . . .", and Mr. Hernandez <br />seconded the motion, which passed unanimously. The Council then <br />voted unanimously for approval of the Ordinance on first reading. <br /> <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows; <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THAT ORDINANCE ADOPTED AUGUST <br />31, 1987 WHICH SET FORTH AN ITEMIZED ESTIMATE OF THE <br />EXPENSE OF CONDUCTING EACH ADMINISTRATIVE UNIT OF THE <br />MUNICIPAL GOVERNMENT OF SAID CITY FOR THE FISCAL YEAR <br />BEGINNING OCTOBER 1, 1987 AND ENDING ON SEPTEMBER 30, <br />1988, AND APPROPRIATED MONEY FOR THE VARIOUS FUNDS <br />AND PURPOSES OF SUCH ESTIMATE, TO REVISE SAID ESTIM- <br />ATES AND TO REAPPROPRIATE SAID FUNDS, ADOPTING SAID <br />REVISIONS AND ESTIMATES, AND DECLARING AN EMERGENCY. <br />
