141 Regular Meeting June 27, 1988 Page 2 Mayor Morris opened the public hearing and asked if anyone wished to speak in favor or in opposition to the Ordinance amendment. Dan Gibson of the Planning Department advised the Council this Ordinance eliminates PUDs. No one wished to speak, so Mayor Morris closed the public hearing. Mr. Moore moved to delete Section 705.9.-26. and to renumber the remaining sections following that section, and Mr. Plummer seconded the motion, which passed unanimously. The Council then voted unanimously for approval of the Ordinance on first reading. Mayor Morris introduced for consideration a public hearing and ap- proval of the Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE GENERAL ZONING ORDINANCE OF THE SAN MARCOS CODE OF ORDINANCES BY CORRECTING AN ERROR IN SECTION 37(B) (1) (a) OFF-STREET PARKING BY PROVIDING FOR SEQUENTIAL NUMBERING IN SECTION 4, DEFINITIONS, AND ESTABLISHING AN EFFECTIVE DATE. Mr. Hernandez moved to approve the Ordinance on first reading and Mr. Plummer seconded the motion, which passed unanimously. Mayor Morris introduced for consideration a public hearing and ap- proval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING APPENDIX C, SUBDIVISIONS, OF THE SAN MARCOS CODE OF ORDINANCES BY THE ADDITION OF AETICLE VI.F. PROVIDING DETAILED WATER SYSTEM REGULA- TIONS, AND ESTABLISHING AN EFFECTIVE DATE. Mayor Morris opened the public hearing and asked if anyone wished to speak in favor or in opposition to the amendment. John Bell, an at- torney representing Elim Water Company, stated they were in support of the amendment except in Part 2., Section F., 4.c. He stated it was a mistake to vary from the Legislature's method of how to purchase a water system. He stated the contract is not attached to this Ordin- ance and therefore provides no flexibility. Mr. Gonzalez stated he does think the Ordinance provides flexibility. Mr. Hankins stated the second paragraph in that section could be deleted, and Mr. Gon. zalez stated another water company had requested that language be included. No one else wished to speak, so Mayor Morris closed the public hearing. Mr. Moore moved to amend the Ordinance in Part 2., Section F., 4.c. to add the following language: "This shall be ar- ranged by a mutually acceptable contract. . . .", and Mr. Hernandez seconded the motion, which passed unanimously. The Council then voted unanimously for approval of the Ordinance on first reading. Mayor Morris introduced for consideration adoption of an Ordinance on emergency, the caption which was read as follows; AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THAT ORDINANCE ADOPTED AUGUST 31, 1987 WHICH SET FORTH AN ITEMIZED ESTIMATE OF THE EXPENSE OF CONDUCTING EACH ADMINISTRATIVE UNIT OF THE MUNICIPAL GOVERNMENT OF SAID CITY FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1987 AND ENDING ON SEPTEMBER 30, 1988, AND APPROPRIATED MONEY FOR THE VARIOUS FUNDS AND PURPOSES OF SUCH ESTIMATE, TO REVISE SAID ESTIM- ATES AND TO REAPPROPRIATE SAID FUNDS, ADOPTING SAID REVISIONS AND ESTIMATES, AND DECLARING AN EMERGENCY.
