He recommended the Council consider <br />the following additions to the work performed: signage - $3,800.00 <br />or less, a covered walkway of metal frame awning to link the build- <br />ings together - $30,300.00, a bell plaza in front of City Hall <br />using the fire bell - $7,500.00, courtyard - $13,200.00, and mov- <br />ing the directory to an area for drive-through viewing in front of <br />City Hall - $7,200.00. <br /> <br />Mayor Morris introduced for discussion a proposed Ordinance creating <br />a Chapter 38 of the Code of Ordinances to prohibit the abandonment <br />of vehicles, restrict the disposition or keeping of wrecked, non- <br />operating or discarded vehicles on streets or private property, pro- <br />vide for impounding of certain vehicles, provide for a hardship ap- <br />peal, impose penalties. Mr. Hankins stated there are two concepts: <br />abandoned and junked vehicles. The provisions allowing 48 hours for <br />compliance will be changed to 45 days in compliance with state law. <br />The Council requested the abandoned and junked vehicle Ordinances be <br />combined and brought back to the Council for consideration. <br /> <br />Mayor Morris introduced a discussion regarding a proposed Ordinance <br />adding Chapter 38 to the Code of Ordinances declaring a no-smoking <br />policy, prohibiting failure to extinguish lighted tobacco in certain <br />circumstances, providing for notice in movie houses, providing for <br />posting of signs, providing for penalties; and a proposed Resolution <br />encouraging proprietors of food service establishments and employee <br />workplaces to designate smoking and non-smoking areas in their faci- <br />lities. The Ordinance and Resolution are recommendations from the <br />temporary committee appointed by the City Council. Mr. Hankins ad- <br />vised the Council the committee did not receive citizen input through <br />a public hearing process. Mr. Moore stated he would like the word- <br />ing in Section 38-1 to be changed to "smoking in publicly owned places" <br />instead of as worded. The Council wanted to refer the proposed Ordin- <br />ance and Resolution back to the Committee for revision through a public <br />hearing process. The Council directed Lisa Hatzenbuehler, staff liaison <br />to the committee, to contact the committee members. The Council wants <br />the committee to review the following in their process: (1) for a <br />public citizen to file on a public citizen; (2) the effect of the <br />O~dinance and Resolution on proprietors; (3) the Legal Department to <br />provide square footage requirements; and (4) enforcement (address the <br />proprietors' concerns). Mr. Gonzalez requested the Council delay <br />direction until the 7 Members of the Council had given consensus for <br />the direction and until Ms. Hatzenbuehler can contact the committee <br />to check their availability to continue. This matter will be rescheduled <br />on a future Council meeting. <br /> <br />Mr. Hernandez moved the Council adjourn into Executive Session pur- <br />suant to Article 6252-17, §2(e), V.A.C.S., to discuss matters where <br />the duties of the City Attorney to the City pursuant to the Code of <br />Professional Responsibility of the State Bar of Texas clearly con- <br />flicts with Article 6252-17, and Mr. Moore seconded the motion, <br />which passed unanimously (10:30 p.m.). <br /> <br />Mr. Hernandez moved the Council reconvene at 11:23 p.m. and Mr. <br />Plummer seconded the motion, which passed unanimously. <br /> <br />The meeting adjourned at 11:25 p.m. on motion made by Mr. Hernandez <br />and seconded by Mr. Plummer. <br /> <br />~l~L ~ <br /> <br />Mayor <br />
