<br />RIO VISTA FALLS RECREATIONAL USE AGREEMENT <br /> <br />This Recreational Use Agreement is by and between the City of San Marcos, <br />Texas, a home rule municipality organized under the constitution and laws of the State <br />of Texas, and the The Red River Racing Team, a Texas non-profit corporation, whose <br />mailing address is 602 1-35 N. San Marcos, TX 78666. <br /> <br />Red River Racing Team (the "Team") desires to use the Rio Vista Falls area for <br />establishing an Olympic slalom course for kayaking. The Red River Racing Team will <br />also endeavor to obtain an official winter training site designation for the Rio Vista Falls <br />slalom course. <br /> <br />As part of their overall plan to promote kayaking and canoeing in the San Marcos <br />River the Team proposes to hold two annual events. These events will be held during <br />the first weekend of November and the first weekend of April. <br /> <br />The City of San Marcos supports responsible recreational use of the San Marcos <br />River, particularly recreational use that will increase tourism and generally benefit the <br />City's economy. <br /> <br />NOW THEREFORE in consideration of the payment to the City of San Marcos by <br />the Red River Racing Team of $ 100.00 (One Hundred Dollars), and for other good and <br />valuable consideration as herein stated, the Parties agree as follows: <br /> <br />I. Real Property <br /> <br />1. The Team shall have nonexclusive use of the Rio Vista Falls area, including <br />the adjoining banks, for the operation of a whitewater sports training site. <br /> <br />2. On the first weekend in November, for the annual Sladeo event, and the first <br />weekend in April, for the annual Springfest event, the Team shall have use of the Rio <br />Vista Falls and adjoining banks to conduct these special events. <br /> <br />3. The use of the River is non-exclusive; however, during the special events the <br />Team will be given priority use of the area <br /> <br />4. Nothing in this Agreement will preclude the City from reqUiring the <br />suspension of use of the Rio Vista Falls area in times of emergency or other public <br />necessity. <br /> <br />II. Personal Propertv/Apertenances <br /> <br />1. The City will provide mounting poles for the Team's use in stringing cable that <br />will hold the gates that are used by the Team in defining slalom courses in the Rio Vista <br />Falls area. <br /> <br />Page 1 of 4 <br />
