<br />2. The Team will insure that all gates are removed, from the Rio Vista Falls <br />area, whenever they are not in use by the Team. The Team is responsible for either <br />removing or securing the gates so that they are not used by unauthorized persons. <br /> <br />3. Nothing in this Agreement will preclude the City from removing, without <br />notice, the poles, wires, or other equipment in the case of emergency or other public <br />necessity. <br /> <br />III. Condition of Premises <br /> <br />1 The Team will be responsible for insuring that Rio Vista Park area is clean <br />and free of litter particularly upon the conclusion of each of the annual events. <br /> <br />2. The Team will maintain the cables and all gates used by the Team. <br /> <br />IV. Term <br /> <br />1. The term of thiS agreement is for one year, beginning January 1, 2008 and <br />ending December 31, 2008. <br /> <br />2. This agreement may be renewed annually, for up to four additional one year <br />periods, upon favorable recommendation to the City Manager by the San Marcos Parks <br />Board. <br /> <br />V. Concessions <br /> <br />During the two special events the Team may operate, or allow the operation of, <br />concessions for the sale of kayaks, canoes, souvenirs, and other goods related to the <br />Team's activities. The Team may operate concessions for the sale of food and drinks <br />only after obtaining written permission from the San Marcos Lions Club. <br /> <br />VI. Insurance <br /> <br />1. The Team shall, at a minimum, procure liability insurance against any liability <br />incurred by Red River Racing and its participants for acts of negligence or willful <br />misconduct In a minimum amount of $1,000,000 for injuries to anyone person and <br />$3,000,000 for injuries to persons arising from each occurrence. <br /> <br />2. All policies of insurance shall name the City of San Marcos as an additional <br />insured. <br /> <br />3. All certificates will provide an endorsement that states the policy will not be <br />changed or canceled until at least 30 days written notice will have been given to the <br />City. <br /> <br />Page 2 of 4 <br />
