streets, and the Property Owners Association will maintain the Storm drains <br />located within lot 5 inside easements dedicated to the City of San Marcos. <br />6.0 Revisions and variances to the PDD and Concept Plan <br />6.1 Approval of this PDD shall be conditioned upon approval of the final plat in <br />conformance with the standards set forth herein. All subsequent site preparation <br />permits, building plans and re -plats shall be subject to compliance with these <br />standards. Deviation from these standards shall be handled as follows: <br />Minor revisions: The Director of Planning and Development Services may <br />administratively approve minor revisions to the PDD or its concept Plan to enable <br />approval of an amending plat if the Director determines there are no significant or <br />major effects to i) areas that are apart of a final plat or, ii) the overall intent of the <br />PDD and its concept Plan. The Directors approval of any minor revision shall be <br />in writing. The following shall be considered a minor revision, subject to the <br />limitations of the Land Development Code: <br />(A) Minor changes up to 10% from adopted City Code will be considered a minor <br />revision to the PDD and may be administratively approved without <br />amendment to the PDD document if the Planning Director determines the <br />basic layout of the project and the overall intent of the project remains the <br />same and functions as well as before the revision. <br />(B) A minor change in the configurations of a lot, if the Planning Director <br />determines the basic layout of the project and the overall intent of the project <br />remains the same and functions as well as before the revision. <br />(C) All other adjustments to the PDD and its concept Plan, that the Planning <br />Director deems does not substantially change the plan, may be approved <br />administratively. <br />Major Revisions and Variances: <br />(A) Proposed changes to development standards, lot size or configuration not <br />determined to be minor by the Director shall cause an application for <br />amendment to the PDD. Such amendment shall follow procedures set forth in <br />the City Code. Upon approval of such major revisions a replat will be <br />required. <br />(B) Variances or special exemptions to the standards of this PDD or the City <br />Code shall be in accordance with the City Code. <br />In witness thereof this agreement is entered between the parties........ . <br />9 <br />
