SEP 2 5 AN 11: 9 I "� <br />The purpose and intent of this document is to define responsibilities, limitations and <br />accepted deviations from the City's code for the development and operation of the <br />subject property. This document is binding on the owner and developer as well as assigns <br />and heirs. <br />2.1 The Vista/Jardin Planned Development District (the "PDD") is submitted to <br />the City of San Marcos for the purpose of securing development rights, <br />procedures and standards to govern the future use and development of the subject <br />property. The PDD is not submitted as a Development Plan under Section 31.161 <br />of the Natural Resources Code V.T.C.A. Upon adoption of the PDD the Owner <br />(and its successors and heirs) waive any right to invoke the processes afforded <br />under Section 31.161 et seq. The PDD and any amendments will be the <br />controlling mechanism for future development unless mutually revoked by both <br />parties. <br />2.2 The PDD provides specific development standards and processes which will <br />apply to all platted or re -platted lots within the overlay district. <br />2.3 When not specifically detailed in this agreement, all development within the <br />PDD will comply with the Land Development Code as of the date of submittal of <br />the development plans. <br />2.4 This PDD overlay allows for flexible design while providing "bonuses" in <br />excess of the City of San Marcos Land Development Code requirements. These <br />enhancements include: <br />• The jogging trail along the West side of Sadler Drive will have fewer <br />interruptions due to use of joint driveways. The trail will be 8 foot wide <br />stabilized granite. <br />• The high quality of building standards used in Vista Plaza project will be <br />maintained in the Office building to be built in lot 5A. <br />• The overall site will exceed the required landscaping requirements of the <br />code. <br />• There will be pedestrian interconnectivity between the different elements <br />of the overall project, thus enhancing the quality of life. <br />• There will be covered parking for residents, tenants and users in excess of <br />code requirements. <br />• The lighting in the Professional Office portion of the project will be <br />designed to minimize glare and disturbance of the residential buildings. <br />3.0 Land Use Summary <br />The site is currently zoned MF -24, with high density residential as land use. This PDD <br />proposes the following zoning: <br />High density Residential: 4.76 acres 28 units per acre, 60 feet building height <br />Professional Office 4.45 acres 75 feet building height <br />pq <br />
