<br />5 <br /> <br />Regular Meeting <br /> <br />August 8, 1988 <br /> <br />Page 2 <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 33, WRECKERS, OF THE <br />CODE OF ORDINANCES OF SAID CITY DELETING ALL REFER- <br />ENCE TO SAN MARCOS DEPARTMENT OF PUBLIC SAFETY AND <br />IN ITS PLACE SUBSTITUTING SAN MARCOS POLICE DEPART- <br />MENT; ADDING SECTION 33-4 REQUIRING CERTIFICATION OF <br />REGISTRATION; RENUMBERING THE REMAINING SECTIONS OF <br />SAID CHAPTER; AMENDING NEW SECTION 33-4 TO ESTABLISH <br />TWO ROTATION FILES BASED ON WRECKER CAPACITY; MODIFY- <br />ING PROVISIONS IN NEW SECTION 33-6 PERTAINING TO THE <br />ROTATION LOG ON WRECKER AVAILABILITY; AMENDING NEW <br />SECTION 33-7 PERTAINING TO THE EQUIPPING OF WRECKERS; <br />AMENDING NEW SECTION 33-9 TO RAISE TOW FEES AND STOR- <br />AGE FEES, AND ESTABLISH A FEE FOR WAITING TIME AND EX- <br />CEPTIONAL LABOR; AMENDING SECTION 33-l0(a) TO INCREASE <br />THE REQUIRED MINIMUM INSURANCE FOR COMBINED SINGLE LIM- <br />IT COVERAGE, FOR CARGO INSURANCE AND THE AMOUNT OF <br />SURETY BOND; CLARIFYING LANGUAGE IN NEW SECTION 33-l0(C) <br />REGARDING ANY COMPLAINT ABOUT A COMMERCIAL TOWING AND <br />WRECKER SERVICE; AMENDING NEW SECTION 33-11 TO ESTABLISH <br />BUSINESS HOURS FOR RELEASE OF IMPOUNDED VEHICLES AND A <br />FEE FOR AFTER-HOUR RELEASE; AND ADDING PROVISIONS FOR <br />POLICE DEPARTMENT INSPECTION OF IMPOUNDED VEHICLES; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Guerra moved for approval of the Ordinance on first reading and <br />Ms. Kissler seconded the motion. Mr. Guerra requested information <br />from other cities regarding this Ordinance, and Mr. Doherty advised <br />he could provide Ordinances from other area cities, but many of the <br />recommendations requested by the local wrecker services had come from <br />Austin's Ordinance. Johnny James advised the Council there are four <br />local companies on the City's rotation system, and that owners of <br />vehicles can request use of a specific company or the rotation system <br />is implemented. The Council requested all four local wrecker companies <br />be advised of the next reading on this Ordinance. Mr. Doherty stated <br />he thinks companies with one wrecker have an unfair advantage by being <br />on the same rotation system as he is when he has additional wreckers <br />in his business that he has operated for 18 years. Mr. Brown asked Mr. <br />Doherty if a person starting out in business with one wrecker would be <br />hurt by a rotation system that would allow Mr. Doherty's business to <br />be called more often because of additional wreckers, and Mr. Doherty <br />stated he started out with one wrecker and built up his business over <br />the years. Mr. Hankins is to provide the Council application fee infor- <br />mation at the next reading of the Ordinance. The Council voted unani- <br />mously for approval of the Ordinance on first reading. <br /> <br />The Council stated Item 6 (Consensus Agenda) would be delayed until <br />after the Execut~ve Session. <br /> <br />Mayor Morris introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ENCOURAGING PROPRIETORS TO DESIGNATE <br />SMOKING AND NON-SMOKING AREAS IN THEIR FACILITIES <br />AND ESTABLISHING AN EFFECTIVE DATE. <br />
