43 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, SEPTEMBER 12, 1988 PRESENT: Mayor Kathy M. Morris Mayor Pro-Tern Council Members Fred Guerra Billy G. Hankins George Boeker Jack Doughty Steve Jenkins Also Present: Melissa Millecam, Patty Wenk, Mark Hendricks, Dan Gibson, Jesse Saucedo, PeeWee Dougherty, Lolly Guerra, Jane Hughson, John Wade, Janace Wade, Bill Haney, Richard Houser, Dan Nelson, Henry Oles, Ben Ford, Jim Gandy and others. Mayor Morris called the meeting to order at 7:30 p.m. Mayor Morris introduced for consideration Item 3.C. on the agenda, a public hearing and adoption of a Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13,1984 (VOL. 66) BY CHANGING THE ZONING OF A 26.49 ACRE TRACT OF LAND LOCATED ON THE WEST SIDE OF BISHOP STREET AT LANCASTER STREET FROM PLANNED UNIT DEVELOPMENT (SINGLE-FAMILY DWELLINGS) TO PLANNED UNIT DEVELOPMENT (ZERO LOT LINE - SINGLE-FAMILY DWELLINGS) FOR SAID 26.49 ACRE TRACT OF LAND; AND DECLARING AN EFFECTIVE DATE. Mayor Morris opened the public hearing and asked if anyone wished to speak for or against the zoning change. Bob Peerman stated the plan was for the development of garden homes with a zero lot line. He stated it was the intention of the development for the Homeowner's Association to maintain the parkland. He stated he would like a crash gate to be placed in the subdivision plans. Mr. Hankins stated it could be added in a plat change, and adjoining owners of property would need to participate. Mr. Peerman also indicated he would like to change the setback. He was requested to take that matter up with the Planning Department to schedule on a Joint Planning and Zoning meeting. Beth Wolpman stated all of Lancaster is not in Mr. Peerman's development, and that they do not want a crash gate, as it would limit access to Lancaster. She stated the Castle Forest Neighborhood Association is generally in favor of the development. No one else wished to speak, so Mayor Morris closed the public hearing. Mr. Moore moved for adoption of the Zoning Ordinance and Mr. Plummer seconded the motion, which passed unanimously (Mr. Guerra was not present during the discussion or consideration of this item).
