<br />44 <br /> <br />Regular Meeting <br /> <br />September 12, 1988 <br /> <br />Page 2 <br /> <br />Mayor Morris introduced for consideration a public hearing and <br />adoption of a Zoning Ordinance (Item 3.A.), the caption which was <br />read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES <br />AND LAND, DATED JUNE 13,1984 (VOL. 66) BY ZONING ALL THAT <br />CERTAIN TRACT OR PARCEL OF LAND LYING AND BEING SITUATED IN <br />HAYS COUNTY, TEXAS, AND BEING THE NORTHEAST PORTION OF LOTS <br />1 AND 2, OF THE THIRD REVISION OF COLLEGE HEIGHTS ADDITION <br />TO THE CITY OF SAN MARCOS, HAYS COUNTY,TEXAS, ACCORDING TO <br />THE MAP OR PLAT OF SAID REVISION OF RECORD IN VOLUME 144, <br />PAGES 182-184 OF THE DEED RECORDS OF HAYS COUNTY, TEXAS, <br />A/K/A 212 LAMAR STREET, FROM "R-1" (SINGLE-FAMILY DWELLING <br />DISTRICT [LOW DENSITY]) AND "MF-3" (MULTI-FAMILY DISTRICT <br />[HIGH DENSITY]); AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Morris opened the public hearing and asked if anyone wished <br />to speak in favor or in opposition to the Zoning Ordinance. Max <br />Warshauer stated he was present to answer any questions the <br />Council may have. No one else wished to speak, so Mayor Morris <br />closed the public hearing. Mr. Hernandez moved for adoption of <br />the Zoning Ordinance and Ms. Kissler seconded the motion. Mr. <br />Moore asked Mr. Hankins if the specific use permit (SUP) process <br />could begin before the zoning was in place, to which Mr. Hankins <br />responded the application process could begin, but the SUP could <br />not be considered until such time as the zoning was effective. <br />The Council voted unanimously for adoption of the Zoning <br />Ordinance. <br /> <br />Mayor Morris introduced for consideration a public hearing and <br />adoption of a Zoning Ordinance, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES <br />AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY ZONING A 12.258 <br />ACRE TRACT OF LAND OUT OF THE J. M. VERAMENDI LEAGUE SURVEY <br />NO.2, AND BEING OUT OF THE SOUTHWEST PORTION OF A TRACT <br />CALLED 22.650 ACRES CONVEYED TO BOLLMAN INDUSTRIES, INC. AND <br />RECORDED IN VOLUME 344, PAGES 53-54 OF THE DEED RECORDS OF <br />HAYS COUNTY, TEXAS, LOCATED AT 101 UHLAND ROAD, FROM "I" <br />(INDUSTRIAL DISTRICT) TO "LI" (LIGHT INDUSTRIAL DISTRICT); <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Morris opened the public hearing and asked if anyone wished <br />to speak in favor or in opposition to the Zoning Ordinance. <br />Henry Oles advised the Council he has an option to purchase the <br />property if the zoning change is approved. Ms. Kissler asked Dr. <br />Oles to address the traffic concerns expressed regarding traffic <br />through the residential area. Dr. Oles stated he does not think <br />there is a problem, because the light industrial development <br />would have access to Post Road and Uhland Road, which would be <br />utilized. No one else wished to speak, so Mayor Morris closed <br />the public hearing. Mr. Guerra moved for adoption of the Zoning <br />Ordinance and Mr. Brown seconded the motion, which passed <br />unanimously. <br /> <br />Mayor Morris introduced for consideration a public hearing and <br />adoption of a Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE FUTURE LAND USE PLAN (MAP) OF THE MASTER <br />PLAN OF SAID CITY, OF 12.258 ACRES LOCATED AT 101 UHLAND <br />ROAD IN THE CITY OF SAN MARCOS, HAYS COUNTY, TEXAS, FROM <br />HIGH DENSITY RESIDENTIAL TO INDUSTRIAL; AND DECLARING AN <br />EFFECTIVE DATE. <br />
