No one did, so <br />Mayor Morris closed the public hearing. Ms. Kissler moved for <br />adoption of the Resolution and Mr. Moore seconded the motion, <br />which passed unanimously. <br /> <br />Mayor Morris introduced for consideration a public hearing and <br />adoption of a Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE FUTURE LAND USE PLAN (MAP) OF THE MASTER <br />PLAN OF SAID CITY, OF 199.23 ACRES LOCATED ALONG COUNTY ROAD <br />140 AT YARRINGTON ROAD IN THE CITY OF SAN MARCOS, HAYS <br />COUNTY, TEXAS, FROM MEDIUM DENSITY RESIDENTIAL, HIGH DENSITY <br />RESIDENTIAL, OFFICE AND PROFESSIONAL, AND INDUSTRIAL, TO <br />COMMERCIAL AND INDUSTRIAL; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Morris opened the public hearing and asked if anyone wished <br />to speak for or in opposition to the land use change. Jim <br />Wittliff was present representing the applicant. He stated this <br />was a good project that he is in favor of. He stated the <br />approval of their plat is only valid for six months, and that he <br />does not know how long it will be before their water concerns are <br />addressed, whether or not San Marcos or Kyle will provide the <br />water. They are unable to finalize their plans or market the <br />property until these concerns are addressed. Mayor Morris <br />advised Mr. Wittliff the City of San Marcos is working with Kyle <br />to address this issue, and that it may be necessary for this <br />development to request an extension of time. No one else wished <br />to speak, so Mayor Morris closed the public hearing. Mr. Guerra <br />moved for adoption of the Resolution and Ms. Kissler seconded the <br />motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration approval of an <br />Ordinance on first reading, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING CHAPTER 30, ARTICLE III, ENTITLED <br />"INDUSTRIAL WASTE ORDINANCE" BY ADDING DEFINITIONS AND <br />OMITTING AND AMENDING DEFINITIONS IN SECTION 30-90; OMITTING <br />"BORON" FROM SECTION 30-91(14) AND CHANGING THE MEASURING <br />SPECIFICATIONS FOR PROHIBITED SOLUTIONS AND SUSPENSIONS OF <br />DISCHARGED ELEMENTS; DELETING OLD SECTION 30-92 ENTITLED <br />"DRAINAGE WATER PROHIBITED" AND RENUMBERING OLD SECTION <br />30-93 AS NEW SECTION 30-92; RENUMBERING ALL SECTIONS IN <br />PROPER SEQUENTIAL ORDER; DELETING FROM NEW SECTION 30-93 <br />"GREASE, OIL AND SAND TRAPS, INTERCEPTORS, OR HOLD HAUL <br />TANKS" AND "SPECIFIC REQUIREMENTS AND EXCEPTIONS"; DELETING <br />FROM NEW SECTION 30-93 "EXEMPTIONS TO PERMIT REQUIREMENTS" <br />AND "MULTIPLE USE BUILDINGS"; DELETING OLD SECTION 30-95; <br />PLACING OLD SECTION 30-95(5) AND (4) INTO NEW SECTION 30-94 <br />AS (12) AND (13); OMITTING REFERENCE IN NEW SECTION 30-94(1) <br />TO EXEMPTIONS UNDER OLD SECTION 30-94; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for approval of the Ordinance on first reading <br />and Mr. Guerra seconded the motion. The changes to the Ordinance <br />are imposed by EPA. The Council voted unanimously for approval <br />on first reading. <br /> <br />Mayor Morris introduced for consideration reconsideration of a <br />Zoning Ordinance. The Council did not wish to reconsider this <br />Ordinance. The caption of this Ordinance reads as follows: <br />
