<br />46 <br /> <br />Regular Meeting <br /> <br />September 12, 1988 <br /> <br />Page 4 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES <br />AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY ZONING ALL THAT <br />CERTAIN TRACT OR PARCEL OF LAND CONSISTING OF 1.40 ACRES OF <br />LAND OUT OF THE J. M. VERAMENDI SURVEY NO.2, SAN MARCOS, <br />HAYS COUNTY, TEXAS, BEING THAT TRACT OF LAND DESCRIBED AS <br />1.5 ACRES IN A DEED FROM WILLIE LEE TOLBERT, WIDOW, TO <br />HATTIE CALVIN, SAID DEED DATED DECEMBER 22, 1971, AND <br />RECORDED IN VOLUME 267, PAGE 159, HAYS COUNTY DEED RECORDS, <br />BEING ALSO A PORTION OF THAT TRACT OF 10 ACRES OF LAND <br />CONVEYED TO JUDGE LAMPKIN, ET UX, BY A. C. WILLIS, ET UX, BY <br />DEED DATED MAY 1, 1938, AND RECORDED IN VOLUME 116, PAGE <br />446, HAYS COUNTY DEED RECORDS, LOCATED AT 132 JACKSON <br />STREET, FROM "Mil (SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD <br />BUSINESSES DISTRICT-) TO "OP" (OFFICE AND PROFESSIONAL <br />DISTRICT); AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Morris introduced for consideration approval of an <br />Ordinance on second reading, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, RENUMBERING SECTIONS 21-1 OF ARTICLE I OF CHAPTER 21, <br />PUBLIC SAFETY, OF THE CODE OF ORDINANCES OF SAID CITY, TO <br />SECTIONS 21-2 AND 21-3, RESPECTIVELY, ADDING A NEW SECTION <br />21-1 THERETO TO CREATE A PUBLIC SAFETY DEPARTHENT WITHIN <br />WHICH ARE THE POLICE AND FIRE DIVISIONS OF SAID CITY, <br />AMENDING SECTIONS 21-2 AND 21-3 THEREOF TO PROVIDE THAT THE <br />POLICE CHIEF AND FIRE CHIEF RESPECTIVELY, SHALL REPORT <br />DIRECTLY TO THE DIRECTOR OF PUBLIC SAFETY, AMENDING SECTION <br />21-13 OF ARTICLE II, SECTION 21-22 OF ARTICLE II 1/2, AND <br />SECTION 21-25 OF ARTICLE III THEREOF TO AMEND THE CITATION <br />TO STATUTORY AUTHORITY TO COMPLY WITH CHANGED STATE LAW, AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for approval of the Ordinance on second reading <br />and Mr. Moore seconded the motion. Mayor Morris moved to amend <br />the Ordinance to include the following preamble: "WHEREAS, the <br />position of Director of Public Safety was created and filled in <br />1985 by the City Council; and, <br /> <br />"WHEREAS, a Department of Public Safety was assumed but not <br />created officially since that time; and, <br /> <br />"WHEREAS, lines of authority between the Director of Public <br />Safety and the Police Chief and Fire Chief have not been clearly <br />defined; and, <br /> <br />"WHEREAS, the formal creation of a Department of Public Safety <br />will be beneficial to the City at this time; and, <br /> <br />"WHEREAS, the City Manager may recommend changes and realignments <br />to the City Council for the Department of Public Safety in the <br />future, as circumstances warrant; and, <br /> <br />"WHEREAS, it is in the interest of the City to establish clear <br />lines of authority and responsibility with respect to the <br />Police Chief, the Fire Chief, the Director of Public Safety and <br />the City Manager in order to improve the management of those <br />governmental functions and carry out the policies of the City <br />Council; now, therefore," and additional wording in Section 21-1, <br />at the beginning of the second sentence: "The director shall be <br />either the Chief of Police or the Fire Chief and. . . .", as <br />read into the record by Mayor Morris, and the motion was seconded <br />by Mr. Brown, which passed unanimously. <br />
