<br />47 <br /> <br />Regular Meeting <br /> <br />September 12, 1988 <br /> <br />Page 5 <br /> <br />Rick Skiles expressed a need for separate departments to be <br />headed by a Fire Chief and a Police Chief, and not a combined <br />head over these departments. Mr. Guerra stated the Council <br />should look at returning to the system of separate Chiefs of Fire <br />and Police who would report to the City Manager. Mayor Morris <br />stated she wants to have strong Chiefs, and that the Director of <br />Public Safety needs to be in place for the cross training <br />discussed during the budget. Mr. Gilley stated there are some <br />details to be worked out regarding assignment pay for <br />cross-trained employees, as they must be paid from the department <br />in which they work. Richard Houser advised the Council there are <br />two firefighters and two police officers who are participating in <br />the cross training. Mayor Morris requested Staff present more <br />options for the Council to consider, and Mr. Brown requested a <br />thorough evaluation and assessment of this program and wants the <br />Council to be briefed before further consideration of this <br />Ordinance. The Council voted unanimously for approval of the <br />Ordinance on second reading. <br /> <br />Mayor Morris introduced for consideration adoption of an <br />Ordinance on third and final reading (erroneously listed on the <br />Council agenda as a second reading), the caption which was read <br />as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING CHAPTER 33, WRECKERS, OF THE CODE OF <br />ORDINANCES OF SAID CITY DELETING ALL REFERENCE TO SAN MARCOS <br />DEPARTMENT OF PUBLIC SAFETY AND IN ITS PLACE SUBSTITUTING <br />SAN MARCOS POLICE DEPARTMENT; ADDING SECTION 33-2 REQUIRING <br />CERTIFICATION OF REGISTRATION; RENUMBERING THE REMAINING <br />SECTIONS OF SAID CHAPTER; AMENDING NEW SECTION 33-4 TO <br />ESTABLISH TWO ROTATION FILES BASED ON WRECKER CAPACITY; <br />MODIFYING PROVISIONS IN NEW SECTION 33-6 PERTAINING TO THE <br />ROTATION LOG ON WRECKER AVAILABILITY; AMENDING NEW SECTION <br />33-7 PERTAINING TO THE EQUIPPING OF WRECKERS; AMENDING NEW <br />SECTION 33-9 TO RAISE TOW FEES AND STORAGE FEES, AND <br />ESTABLISH A FEE FOR WAITING TIME AND EXCEPTIONAL LABOR; <br />ADDING NEW SECTION 33-10 ESTABLISHING AN ADMINISTRATIVE FEE; <br />RENUMBERING SECTION 33-10 AND 33-11 AND RENUMBERING <br />SUBSEQUENT SECTIONS; AMENDING NEW SECTION 33-11(a) TO <br />INCREASE THE REQUIRED MINIMUM INSURANCE FOR COMBINED SINGLE <br />LIMIT COVERAGE, FOR CARGO INSURANCE AND THE AMOUNT OF SURETY <br />BOND; CLARIFYING LANGUAGE IN NEW SECTION 33-11(c) REGARDING <br />ANY COMPLAINT ABOUT A COMMERCIAL TOWING AND WRECKER SERVICE; <br />AMENDING NEW SECTION 33-12 TO ESTABLISH BUSINESS HOURS FOR <br />RELEASE OF IMPOUNDED VEHICLES AND A FEE FOR AFTER-HOUR <br />RELEASE; AND ADDING PROVISIONS FOR POLICE DEPARTMENT <br />INSPECTION OF IMPOUNDED VEHICLES; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mr. Hernandez moved for adoption of the Ordinance on third and <br />final reading and Mr. Moore seconded the motion. Mayor Morris <br />moved to amend the Ordinance in the caption to add the following <br />language in the sixteenth line: "ADDING NEW SECTION 33-10 <br />ESTABLISHING AN ADMINISTRATIVE FEE; RENUMBERINTG SECTION 33-10 TO <br />33-11 AND RENUMBERING SUBSEQUENT SECTIONS," adding the following <br />sentence to the end of Section 33-9. Fees. (6): "If inside <br />storage is requested by the Police Department, the City shall pay <br />the difference between the regular storage and inside storage <br />fee," and adding the following language to Section 33-10: <br />"Administrative Fee. In addition to the charges provided in Sec. <br />33-9, each wrecker service shall charge and collect $5.00 for <br />each tow performed under this Chapter. Such amounts collected <br />shall be paid to the City on the 10th of each month for all such <br />collections made during the preceding month," and Mr. Brown <br />seconded the motion, which passed unanimously (Mr. Moore not <br />present to vote on this amendment).
