Regular Meeting October 2, 2007 Page 9 <br />AYE: Thomaides, Couch, Bose, Narvaiz, Guerrero and Robertson. <br />NAY: Jones. <br />ABSTAIN: None. <br />Mayor Narvaiz introduced for consideration a public hearing and adoption of <br />Zoning Ordinance, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MAROCS, TEXAS, <br />REPEALING A PLANNED DEVELOPMENT DISTRICT OVERLAY FOR 239.4 ACRES, MORE <br />OR LESS, IN THE WILLIAM WARD SURVEY, KNOWN AS THE BLANCO RIVERWALK <br />SUBDIVISION; APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP FROM <br />"HDR" HIGH DENSITY RESIDENTIAL TO "MU" MIXED USE, FOR A 15.065 ACRE, <br />MORE OR LESS, TRACT OF LAND LOCATED IN THE BLANCO RIVERWALK <br />SUBDIVISION AT THE 2700 BLOCK OF IH -35 NORTH; FOR AMENDING THE <br />OFFICIAL ZONING MAP OF THE CITY BY REZONING THIS TRACT FROM "MF -24" <br />MULTI - FAMILY DISTRICT TO "MU" MIXED USE DISTRICT; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to speak. <br />1) Steve Ramsey, Baker and Aicklen, stated he is representing the developer <br />and is present to answer any questions. Ms. Couch moved for adoption of <br />Zoning Ordinance, and Mr. Thomaides seconded the motion. Ms. Robertson <br />inquired to the CCR. Mr. Ramsey stated the CCR has not been offered at this <br />time, but will be part of the final plats. Mayor Narvaiz stated the Planning <br />and Zoning Commission based their decision with the same information the <br />Council was provided. Ms. Robertson inquired to the park parking. Mr. <br />Pennington stated the applicant has agreed to post sign regarding parking, <br />which can read for Park Parking only. Mr. Thomaides inquired to what the <br />developers had done and what they are going to do, and what is happening <br />now. Mr. Pennington stated this would be provided in the Master <br />Development, which would provide specific guidelines. He stated the <br />applicants have agreed to do a CCR for private restrictions, which is going <br />above and beyond and better than Code. The Council then voted unanimously <br />for adoption of the Zoning Ordinance. <br />Mayor Narvaiz introduced for consideration of adoption of a Zoning <br />Ordinance. The Council choice not to reconsider the Zoning Ordinance, the <br />caption reads as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP FROM INDUSTRIAL TO <br />COMMERCIAL FOR A 29.42 ACRE, MORE OR LESS, TRACT OF PROPERTY LOCATED <br />AT 4500 IH -35 SOUTH; AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY <br />
