<br />81 <br /> <br />Regular Meeting <br /> <br />December 12, 1988 <br /> <br />Page 3 <br /> <br />Mr. Moore moved for approval of the Ordinance on second reading <br />and Ms. Kissler seconded the motion. Dan Gibson advised the <br />Council the wording in PART 15 has always been there; it is just <br />being clarified and made more similar to the wording in the <br />Building Code. Mr. Moore moved to amend the Ordinance in the <br />caption to change the word dormitories to residence halls, and to <br />add to the caption in the next to last line: "adding and amending <br />definitions"; to amend PART 15 to read as follows: "That <br />Appendix A - General Zoning Ordinance, Section 4, be amended by <br />deleting the definition for "structural alterations" and <br />substituting therefor the following: <br /> <br />"Any change in supporting members of a building such as <br />load-bearing walls, columns, girders, beams, or the entire <br />roof; or the enlargement, moving, or demolition of any <br />portion of a building involving such supporting members;" <br /> <br />and to amend PART 16 as follows: "That Appendix A - General <br />Zoning Ordinance, Section 4, be amended by deleting the <br />definition of "dormitory" and substituting therefor in proper <br />alphabetical and numerical sequence the following definition of <br />"residence hall"; <br /> <br />"A building containing group living quarters as an accessory <br />use for a college, university, boarding school, orphanage, <br />convent, monastery, or other similar institution or <br />organization." <br /> <br />Mr. Guerra seconded Mr. Moore's amendment, which passed <br />unanimously. The Council then voted unanimously for approval of <br />the Ordinance on second reading. <br /> <br />Mayor Morris introduced for consideration adoption of an <br />Ordinance on third and final reading, the caption which was read <br />as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 16-3 OF ARTICLE I OF CHAPTER 16, <br />MISCELLANEOUS OFFENSES AND PROVISIONS, OF THE CODE OF <br />ORDINANCES OF SAID CITY TO CHANGE ALL REFERENCES TO <br />"AQUARENA, INC." TO "AQUARENA SPRINGS CORPORATION," TO ALLOW <br />GUESTS AND PERMITTEES OF SAID CORPORATION CERTAIN RIGHTS <br />WITH RESPECT TO SPRINGLAKE AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Guerra moved for adoption of the Ordinance on third and final <br />reading and Mr. Hernandez seconded the motion. Mr. Moore moved <br />to amend the Ordinance to substitute a revised version of the <br />Ordinance, which was read into the record in its entirety, which <br />caption reads as follows, and Mr. Hernandez seconded the motion: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 16-3 OF ARTICLE 1 OF CHAPTER 16, <br />MISCELLANEOUS OFFENSES AND PROVISIONS, OF THE CODE OF <br />ORDINANCES OF SAID CITY TO PROVIDE FOR THE PROTECTION OF <br />PERSONS USING PUBLIC WATERS IN SPRINGLAKE AND PROHIBITING <br />VIOLATIONS OF LAW ASSOCIATED WITH THE USE OF PUBLIC WATERS <br />IN SPRINGLAKE AND DECLARING AN EFFECTIVE DATE. <br /> <br />The Council voted unanimously for approval of the amendment. <br />Brown stated he wants to preserve archeological studies, and <br />Hankins stated this Ordinance will not prohibit anything now <br />allowed by State Law (Parks and Wildlife Code).
