Dave <br />Newman stated he located in San Marcos because of the beauty of <br />the area. He stated this Ordinance would deny a lot of people of <br />enjoyment, and that he has been swimming and diving from the <br />falls for 15 years. Zeal Stephanoff stated he is an activist, <br />and is here for the river and enjoys the river. He stated if the <br />Council is concerned about health and welfare of the citizens, <br />that the Council get the river cleaned up, as the river is part <br />of the quality of life of San Marcos. Brian Archer expressed <br />concern for the Council possibly adopting the Ordinance too <br />hastily. He asked the Council who is being protected by this <br />Ordinance, the citizens or Aquarena. Allen Holstrom stated <br />Aquarena was pressured by their insurance carrier to address the <br />hazard of the dam. He stated the owners should address the <br />concern, not the City through an Ordinance. He stated he felt <br />this was an extreme action on the part of the Council, and that <br />it would hinder too many people from enjoyment of the river. Mr. <br />Brown asked Staff for other options of how to control this <br />situation, such as trespass laws on private property and the rate <br />of flow from the dam. On roll call for approval on first <br />reading, the following vote was recorded: <br /> <br />Aye: <br /> <br />Moore, Hernandez, Brown, Morris, Guerra, Plummer. <br /> <br />Nay: <br /> <br />None. <br /> <br />Abstain: <br /> <br />Kissler. <br /> <br />Mayor Morris introduced for consideration approval of an <br />Ordinance on first reading, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING CHAPTER 29, TRAFFIC, OF THE SAN MARCOS CODE <br />OF ORDINANCES, DELETING UNNECESSARY LANGUAGE AND ALTERING <br />INAPPROPRIATE TERMINOLOGY, AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Hernandez moved for approval of the Ordinance on first <br />reading and Ms. Kissler seconded the motion, which passed <br />unanimously. <br /> <br />Mayor Morris introduced for consideration approval of an <br />Ordinance on second reading, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING APPENDIX A - GENERAL ZONING ORDINANCE OF THE <br />CODE OF ORDINANCES OF SAID CITY BY MODIFYING THE DEFINITION <br />OF HOME OCCUPATION; DELETING THE DEFINITION OF PLANNED UNIT <br />DEVELOPMENT; RENUMBERING THE REMAINING DEFINITIONS; <br />CLARIFYING THE APPLICATION PROCESS FOR MASTER PLAN LAND USE <br />AMENDMENTS; ADDING "c" COMMERCIAL DISTRICT USE AS A SPECIFIC <br />USE TO LIGHT INDUSTRIAL DISTRICTS; ADDING "LI" LIGHT <br />INDUSTRIAL DISTRICT USES TO INDUSTRIAL DISTRICTS; ADDING THE <br />CONDITION THAT A SPECIFIC USE MUST BE CONSISTENT WITH THE <br />POLICIES OF THE MASTER PLAN; CLARIFYING THE CONDITIONS ON A <br />SPECIFIC USE PERMIT; ADDING CONDITIONS TO OFF-STREET PARKING <br />REQUIREMENTS IN THE CENTRAL BUSINESS AREA, AND FOR <br />DORMITORIES, FRATERNITY AND SORORITY BUILDINGS; DELETING <br />EXCESS LANGUAGE DESCRIBING THE CENTRAL BUSINESS DISTRICT FOR <br />OFF-STREET PARKING REQUIREMENTS; DELETING A CROSS-REFERENCE <br />IN NONCONFORMING LOTS; ADDING AN ADDITIONAL CONDITION FOR A <br />ZONING VARIANCE REQUEST TO THE ZONING BOARD OF ADJUSTMENTS; <br />ADDING AND AMENDING DEFINITIONS; AND DECLARING AN EFFECTIVE <br />DATE. <br />
