a.m. until 5:00 p.m. Monday through Friday in accordance with local, state and <br />federal rules and regulations. When the Airport Manager or staff is not at the <br />Airport premises, Operator and its staff shall be reasonably available. The <br />Operator will designate a staff contact for 24 -hour per day emergency services <br />and provide the contact information to the City Manager. Operator shall use <br />emergency procedures established in Chapter 10 of the San Marcos Code for <br />emergencies as well as any other emergency procedures established by City. <br />3.1.16 Airport Manager. Operator shall at all times employ a person designated as the <br />Airport Manager who shall, among his list of his or her other duties, serve as <br />Operator's liaison with the City and who shall be Operator's representative <br />primarily responsible for dealing with the City Manager, City Airport <br />Commission, City Council, City employees, and any governmental entities. <br />a. The Airport Manager shall supervise Airport activity and assure the <br />availability and continuity of public services at the Airport. The Airport <br />Manager shall provide direction and support to all airport lessees and tenants <br />on a fair and reasonable basis. The Operator shall, prior to the end of the <br />Transition Period, provide to the City a written delegation of authority which <br />shall, at a minimum, authorize the Airport Manager to perform the duties, <br />obligations, and responsibilities of the Airport Manager set forth in this <br />Agreement. <br />b. The Airport Manager shall meet and communicate with the City Manager on a <br />regular basis. The Airport Manager or his designee shall attend the regularly <br />scheduled meetings of the City Council (when airport issues will be discussed <br />at the meeting) and City Airport Commission as may be requested by the City. <br />The Airport Manager shall inform the City Manager of all emergencies and <br />the occurrence of any unforeseen circumstances relating to the Airport which <br />an independent operator would be expected to report to an owner under <br />customary and prudent business practices. <br />c. The City Manager shall have the right to approve the Airport Manager <br />designated by Operator. If the Airport Manager's performance is <br />unsatisfactory to the City Manager, City Manager will notify the Airport <br />Manager in writing. If the Airport Manager has not cured the unsatisfactory <br />performance as set for in the notice promptly following such notice, the <br />Airport Operator shall remove the Airport Manager and appoint a replacement <br />satisfactory to the City within 45 days. <br />3.1.17 Other Personnel. Operator shall employ an Airport staff comprised of qualified <br />persons who shall perform their duties at the Airport in accordance with this <br />Agreement. Sufficient staff shall be available and present to carry out Operator's <br />obligations under this Agreement, including staffing in accordance to the <br />approved staffing plan in this Agreement and such other schedule as may from <br />time to time be set by the City.
