excused by uncontrollable circumstances, the Operator will comply with all <br />contract standards continuously. If the Operator fails to comply with any of the <br />contract standards, it will at its own cost and expense: <br />a. Promptly notify the City of such non - compliance within eight hours of the <br />discovery that a non - compliant condition exists; <br />b. Promptly provide the City with any notice received from any government <br />regulatory body within 12 hours of its receipt of the notice; <br />c. Pay any related damages or fines and hold harmless, indemnify and defend the <br />City and its officers, agents and employees from all related liabilities and <br />damages in accordance; <br />d. Pay any costs related to public notification required by the non - compliance; <br />and <br />e. Take all action necessary to restore compliance with the contract standards <br />and prevent a recurrence of non - compliance. <br />3.3.2 Supervise compliance with FAA, TCEQ and TxDOT regulations and perform all <br />needed regulatory interface including assisting City with obtaining, modifying or <br />renewing permits, and reporting, notifying, inspections and related activities as <br />required by Federal, State or Local agencies having jurisdiction over the Airport. <br />3.3.3 Cooperate with and assist the City in dealing with all Federal, State and local <br />agencies in matters related to the operation and management of the Airport. In <br />addition, the Operator will prepare and submit financial and other reports to the <br />appropriate entities as related to Federal and State grants and obligations. <br />3.3.4 Operator agrees to conform to existing grant agreements between City and FAA, <br />including related FAA assurances. <br />3.4 AIRPORT DEVELOPMENT AND MARKETING PLAN <br />The Operator will: <br />3.4.1 Actively market the Airport to potential users, including aircraft owners and <br />operators, as well as operators of support services. In addition, the Operator will <br />actively promote high quality development of the Airport, including commercial <br />operations for lawful purposes, provided such uses comply with all applicable <br />laws, regulations, ordinance and rules. The Operator will use its best efforts to <br />promote such development with the twin goals of optimizing the Airport's <br />financial performance, to make it as self - sustaining as possible and promote <br />economic development of the Airport. All costs associated with the marketing of <br />the Airport as stipulated in this subsection will be borne by the Operator. <br />3.4.2 Periodically prepare and keep current a comprehensive information brochure <br />regarding the Airport, subject to review and approval by the City, and make <br />
