40 Regular Meeting January 12, 1987 Page 6 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN ~~RCOS, TEXAS, AMENDING THE GENERAL ZONING ORDINANCE OF THE SAN ~1ARCOS CODE OF ORDINANCES BY CLARIFYING SECTION 2(D) (2) AND BY ADDING SECTION 2(D) (3) TO PROVIDE FOR ZONING COMMISSION CONSIDERATION OF AL- TERNATIVE ZONING DESIGNATIONS AND ESTABLISHING AN EFFECTIVE DATE. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE SEWAGE SYSTEM CAPITAL RECOVERY FEE ORDINANCE AND THE WATER SYSTEM CAPITAL RECOVERY FEE ORDINANCE BY PROVIDING AN EXEMPTION FOR LOCAL TAXING UNITS AND DECLARING AN EFFECTIVE DATE. AN ORDINANCE GRAurING THE AUTHORITY, RIGHT AND PRIVI- LEGE TO OPERATE AND MAINTAIN A SATELLITE MASTER ANTENNA TELEVISION SIGNAL DISTRIBUTION SERVICE FOR THE DISTRIBU- TION OF AUDIO, VIDEO AND RADIO SIGNALS, PROVIDING THE TERMS AND PROVISIONS UNDER vffiICH SAID SYSTEM SHALL BE OPERATED AND MAINTAINED, AND DECLARING AN EFFECTIVE DATE. Mayor Younger introduced for consideration the Ordinance pulled from the consensus agenda, adoption of an Ordinance on third and final reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ESTABLISHING THE GENERAL AND SPECIFIC AUTHORITY OF THE SAN MARCOS ELECTRIC UTILITY BOARD AND DECLARING AN EFFECTIVE DATE. Mr. Farr moved for adoption of the Ordinance on third and final read- ing and Mayor Younger seconded the motion. Mr. Brown moved to amend the Ordinance in Chapter 9 1/2, Sec. 9-1/2-2. (b) to read as follows: " .. public hearing must be given with said publications not more than twenty-two (22) days nor less than eight (8) days before the public hearing is held," and to amend Section 9-1/2-3. (b) to read as follows: " . . . public hearing must be given with said publications not more than twenty-two (22) days nor less than eight (8) days before the public hearing is held," and to amend Section 9 1/2-3. (e) to read as follows: " . . . take effect sooner than thirty (30) days. . . .", and Mayor Younger seconded the motion, which passed unanimously. The Council then voted unaniTIously for adoption of the Ordinance on third and final reading. Mayor Younger introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING FINAL PAYMENT TO P. A. STARK CONSTRUCTION, INC. FOR CONSTRUCTION OF THAT PROJECT KNOWN AS MILLVIEW AREA WATER AND WASTEWATER, STREETS AND DRAINAGE IMPROVEMENTS PROJECT, AUThORIZING FINAL PAYMENT IN THE AMOUNT OF $12,698.60, AND DECLARING AN EFFECTIVE DATE. Ms. Kissler moved for adoption of the Resolution and Mr. Guerra second- ed the motion. On roll call the following vote was recorded: AYE: Brown, Farr, Younger, Kissler. NAY: Guerra, Nicola. ABSTAIN: None.
