<br />57 <br /> <br />Regular Meeting <br /> <br />~Tanuary 26, 1987 <br /> <br />Page 2 <br /> <br />Mayor Younger introduced a public hearing and approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS_, TEXAS, AMENDING EXHIBIT A OF APPENDIX G, <br />HISTORICAL ZONING ORDINANCE OF THE SAN MARCOS CODE <br />OF ORDINANCES TO INCLUDE THE PROPERTY KNO~~ AS 819 <br />BELVIN STREET IN THE BELVIN STREET HISTORICAL DISTRICT <br />BOUNDARY, AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Younger opened the public hearing and asked if anyone wished <br />to speak in favor or in opposition to the amendment. No one did, <br />so Mayor Younger closed the public hearing. Ms. Kissler moved for <br />approval of the Ordinance on first reading and Mr. Guerra seconded <br />the motion, which passed unanimously. <br /> <br />Mayor Younger introduced a public hearing and approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: GRANTING THE CONSENT OF THE CITY OF <br />SAN MARCOS TO THE CREATION OF A MUNICIPAL UTILITY <br />DISTRICT: LmVMAN RANCE MUNICIPAL UTILITY DISTRICT <br />SUBJECT TO VARIOUS TERMS AND CONDITIONS SET FORTH IN <br />A SEPARATE AGREEMENT REGARDING THE DEVELOPMENT OF <br />SAID DISTRICT WHICE IS MADE A PART OF THIS ORDINANCE, <br />AUTHO~ING THE MAYOR TO EXECUTE SAID AGREEMENT, AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Younger opened the public hearing and asked if anyone wished to <br />speak in favor of the Ordinance. Patsy Greiner passed out to the <br />Council Exhibits A, Band C. Ms. Greiner stated Section 3.03 provided <br />a dedication of a 15-acre site, after 500 rooftops are constructed, to <br />the School District; Section 3.04 provides approximately 30 acres for <br />parkland and refers to Exhibit C for 15 acres to be jointly School <br />District and parkland; Section 3.06 states LRL will participate with <br />a City plan regarding affordable housing. Mr. nicola expressed <br />disapproval of Sections 3.03 (School Site) and 3.04 (Parkland). LRL <br />is to explore the possibility of a homeowners' Association maintaining <br />the parkland until such time as the property is annexed. Mr. Nicola <br />requested more clarification of Section 3.06 (Affordable hou$ing) regard- <br />ing the diminution of value of property, and LRL's attorney, Jody Richard- <br />son, stated LRL does not want the value of the land to affect LRL's <br />ability to service the bond debt. In response to Mr. Farris question <br />regarding Section 2.01 (Standards for Construction) pertaining to land- <br />scaping, Jeff Lewis, Trustee for LRL, stated he wanted them to be able <br />to submit for approval when they were ready for it to be applied, and <br />that possibly Mr. Hankins could write a deed restriction with wording <br />such as, "Zoning and Landscaping Ordinances and as amended". Mr. Nicola, <br />referring to Mr. Hankins' memorandum to the Council dated January 23, <br />1987, attached to these minutes, requested the language be changed in <br />Section 2.01 in Line 10 from the City has "no authority" to "limited <br />authority". Ms. Richard stated LRL will pay for arbitration. Mr. <br />Farr referred to Section 3.02 (Fire Station/EMS Site) for possible re- <br />vison; and Mr. Hankins reviewed Sections 3.05 (Electricity Service) <br />and 3.02 (Fire Station/EMS Site) of his Memorandum. No one else wished <br />to speak for or against the Ordinance, so Mayor Younger closed the public <br />hearing. Ms. Kissler moved for approval of the Ordinance and Mayor <br />YoUnger seconded the motion. On roll call the following vote was re- <br />corded: <br />
