<br />39 <br /> <br />Regular Meeting <br /> <br />March 23, 1987 <br /> <br />Page 2 <br /> <br />Mayor Younger introduced for consideration a public hearing and adop- <br />tion of a Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, <br />1984 (VOL. 66) BY CHANGING THE ZONING OF 199.62 ACRES, <br />MORE OR LESS, OF LAND IN THE J. M. VERAMENDI LEAGUE NO. <br />1 A-17 AND THE JAMES CURTIS SURVEY A-3, HAYS COUNTY, <br />TEXAS, FROM BEING UNZONED AND "PD" (PRE-DEVELOPMENT <br />DISTRICT) TO "PDD" (PLANNED DEVELOPMENT DISTRICT) ; <br />APPROVING A PDD DEVELOPMENT PLAN FOR SAID 199.62 ACRE <br />TRACT; APPROVING A SITE PLAN FOR SAID 199.62 ACRE TRACT <br />IN ACCORDANCE WITH CHAPTER 36, SAN MARCOS RIVER CORRIDOR, <br />OF THE CODE OF ORDINANCES OF SAID CITY; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mayor Younger opened the public hearing and asked if anyone wished to <br />speak in favor or in opposition to the zoning change. Jim Byrn was <br />present representing the owners of the property. Mr. Brown asked Mr. <br />Byrn about the development of a park along the river. Mr. Byrn indi- <br />cated there is a proposed development and that some agreements have <br />been made wherein the owner will maintain the park until a certain <br />percentage of the development is completed. Frank Robbins stated <br />this matter will be addressed in the final platting before the Planning <br />Commission. No one else wished to speak for or against, so Mayor <br />Younger closed the public hearing. Bernie <br />Bowden, owner of the property, was present to answer any questions <br />of the Council. No one else wished to speak in favor or in opposition, <br />so Mayor Younger closed the public hearing. Ms. Kissler moved for <br />adoption of the Zoning Ordinance and Mr. Guerra seconded the motion, <br />which passed unanimously. <br /> <br />Mayor Younger introduced for consideration a public hearing and adop- <br />tion of a Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE FUTURE LAND USE PLAN <br />(MAP) OF THE MASTER PLAN OF SAID CITY, FOR 199.62 <br />ACRES LOCATED ON THE NORTHEAST SIDE OF F.M. 621, <br />ADJACENT TO THE STATE FISH HATCHERY FROM LOW DENSITY <br />RESIDENTIAL AND PERMANENT OPEN SPACE/FLOOD PLAIN TO <br />COMMERCIAL, MEDIUM DENSITY RESIDENTIAL AND PERMANENT <br />OPEN SPACE/FLOOD PLAIN; AND DECLARING AN EFFECTIVE <br />DATE. <br />
