<br />40 <br /> <br />Regular Meeting <br /> <br />March 23, 1987 <br /> <br />Page 3 <br /> <br />Mayor Younger opened the public hearing and asked if anyone wished <br />to speak in favor or in opposition to the land use change. No one <br />did, so Mayor Younger closed the p~blic hearing. Mr. Coddington <br />moved for adoption of the Resolution and Mr. Farr seconded the mo- <br />tion, which passed unanimously. <br /> <br />Mayor Younger introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, REPEALING ARTICLE III OF CHAPTER 5 <br />OF THE SAN MARCOS CODE OF ORDINANCES AND ADOPTING <br />NEW CHAPTER 5, ARTICLE III. FLOOD DAMAGE PREVENTION <br />CONSISTENT WITH THE LATEST FEDERAL REGULATIONS FROM <br />FEMA AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for approval of the Ordinance on first reading and <br />Mr. Farr seconded the motion. Mr. Robbins advised the Council this <br />amendment will make the Ordinance less restrictive. Some of the <br />changes are the Planning Commission will serve as an Appeals Board <br />and mobile homes (manufactured housing) can build within the floodway <br />if a study is done (as other developments can do). Mr. Coddington <br />stated there is another alternative, and that is not to be in the <br />Flood Insurance Program. On roll call the following vote was recorded: <br /> <br />AYE: <br /> <br />Brown, Farr, Younger, Guerra, Kissler, Nicola. <br /> <br />NAY: <br /> <br />Coddington. <br /> <br />ABSTAIN: <br /> <br />None. <br /> <br />Mayor Younger introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 29-152 OF THE SAN <br />MARCOS CODE OF ORDINANCES BY ADDING A NO PARKING/ <br />TOW-AWAY ZONE ON BOTH SIDES OF PLEASANT DRIVE AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Farr moved for approval of the Ordinance on first reading and <br />Mayor Younger seconded the motion, which passed unanimously. <br /> <br />Mayor Younger introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, DECLARING THE PROPERTY ON WHICH THE <br />OLD FISH HATCHERY BUILDING SITS AS PARKLAND AND <br />ESTABLISHING AN EFFECTIVE DATE. <br /> <br />Mr. Farr moved for approval of the Ordinance on first reading and <br />Mr. Brown seconded the motion. Mr. Cobb stated Mr. and Mrs. Lee <br />Shroeder went before the Parks and Recreation Board and requested <br />this Ordinance b~ reconsidered by the Council. Mr. Shroeder advised <br />the Council they did not want to put funds into a xeriscaping project <br />unless it is to be permanent, and that additional funds will become <br />available in the future for this project. He stated the Master Plan <br />calls for parkland along the river, and that is a suitable use of the <br />property. Mr. Shroeder stated this is one of the most visible areas <br />in San Marcos for such plantings, and that the project has been started <br />by the Beautification Committee of the Chamber of Commerce.
