<br />45 <br /> <br />Regular Meeting <br /> <br />March 23, 1987 <br /> <br />Page 8 <br /> <br />Mr. Nicola moved that the Zoning Ordinance be reconsidered by the <br />City Council at a future meeting and that the City Secretary publish <br />notice of public hearing, and Ms. Kissler seconded the motion, which <br />passed unanimously. <br /> <br />Mayor Younger introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN APPLICATION FOR A GRANT <br />FOR LIBRARY SERVICES, AUTHORIZING THE LIBRARY DIRECTOR <br />TO SUBMIT THE GRANT APPLICATION AND ESTABLISHING AN <br />EFFECTIVE DATE. <br /> <br />Mr. Coddington moved for adoption of the Resolution and Mr. Brown se- <br />conded the motion. Mr. Coddington raised the question of whether or <br />not it was necessary to specify who the purchases would be made from. <br />Mr. Guerra stated he would not vote on this item because of possible <br />conflict of interest. On roll call the following vote was recorded: <br /> <br />AYE: <br /> <br />Brown, Coddington, Farr, Younger, Kissler, Nicola. <br /> <br />NAY: <br /> <br />None. <br /> <br />ABSTAIN: <br /> <br />Guerra. <br /> <br />Mayor Younger introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING PROPOSED LEGISLATION TO MAKE <br />MUNICIPAL COURT A COURT OF RECORD, ENCOURAGING SUPPORT <br />FOR THE PROPOSED LEGISLATION AND DECLARING AN EFFECT- <br />IVE DATE. <br /> <br />Mr. Farr moved for adoption of the Resolution and Mr. Brown seconded <br />the motion. The Council discussed that they wanted a peace officer <br />to work under the Municipal Court Judge (or warrant officer) and to <br />be separate from the Police Department. Mr. Hankins stated the <br />Council could possibly adopt a city marshal provision instead of <br />using 1269m and that he would review this possibility. The Council <br />directed that he pursue all options and make a report at the next <br />meeting. Mr. Coddington stated he did not think the Municipal Court <br />had many appeals to make such a fiscal commitment. He stated the <br />Court would have to have a court reporter to transcribe the appeals <br />and hire a bailiff or warrant officer. Mr. Hankins stated he thought <br />the information he provided the Council reflected there had been approxi- <br />mately 160-260 appeals this past year. Mr. Hankins stated that tran- <br />scripts had to be certified but there was no requirement they be done <br />by a court reporter. On roll call the Council voted unanimously for <br />adoption of the Resolution. <br /> <br />Mayor Younger introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING A CONTRACT BETWEEN THE CITY <br />AND TEXAS DEPARTMENT OF COMMUNITY AFFAIRS FOR A RENTAL <br />REHABILITATION PROGRAM; AUTHORIZING THE MAYOR TO EXE- <br />CUTE THE CONTRACT AND ANY FUTURE DOCUMENTS RELATING TO <br />IT AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />Mr. Farr moved for adoption of the Resolution and Mr. Coddington se- <br />conded the motion, which passed unanimously. <br />
