<br />44 <br /> <br />Regular Meeting <br /> <br />February 23, 1987 <br /> <br />Page 3 <br /> <br />Mayor Younger asked if anyone wished to speak in favor or in opposi- <br />tion to the Zoning request. Joe Wester of the Westover area advised <br />the Council there was already too much traffic until the streets are <br />improved. Mr. Robbins advised the Zoning Commission had approved <br />the request conditionally: with access on to Del Mar and no curb <br />cut on Bishop Street. Mr~ Robbins advised improvements are scheduled <br />for streets in the Westover area in the CIP program in the Spring of <br />1988. No one else wished to speak in favor or in opposition, so <br />Mayor Younger closed the public hearing. Mr. Guerra moved for adoption <br />of the Zoning Ordinance with the condition that roadway access be only <br />off of Del Mar and Mr. Brown seconded the motion. On roll call the <br />following vote was recorded: <br /> <br />AYE: <br /> <br />Brown, Guerra, Nicola. <br /> <br />NAY: <br /> <br />Coddington, Farr, Younger, Kissler. <br /> <br />ABSTAIN: <br /> <br />None. <br /> <br />The motion failed. <br /> <br />Mayor Younger introduced a public hearing and adoption of a Zoning <br />Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, <br />1984 (VOL. 66) BY ZONING BLOCK 10, LOTS D AND E OF <br />SCHNEIDERS REARRANGEMENT OF LOTS 51 AND 52, BLOCK 10 <br />OF THE WESTOVER ADDITION TO THE CITY OF SAN MARCOS <br />AS RECORDED IN VOLUME 4, PAGE 275 OF THE HAYS COUNTY <br />PLAT RECORDS, LOCATED AT THE SOUTH CORNER OF THE IN- <br />TERSECTION OF CLYDE STREET AND BAYLOR STREET, FROM <br />"R-l" (SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]) <br />TO "DP-2" (DUPLEX DISTRICT [MEDIUM DENSITY]); AND DE- <br />CLARING AN EFFECTIVE DATE. <br /> <br />Mayor Younger opened the public hearing and asked if anyone wished to <br />speak in favor or in opposition to the zoning request. Laura Schneider <br />stated she was representing Comet Construction. She stated they had <br />the zoning changed to "R-l" some time ago because with the low density <br />land use designation, they thought that is all the property could be <br />zoned. When talking with the Planning Staff, they were advised that <br />"DP-2" zoning was acceptable with the land use designation, so they <br />are now requesting the property be rezoned to "DP-2". Joe Wester <br />representing the Westover area stated the neighborhood is opposed <br />to the City allowing additional duplex zoning, because it would in- <br />crease the traffic more than "R-l" zoning. He stated the Police De- <br />partment does their job in trying to control the traffic on Bishop, <br />but that Bishop is not wide enough to carry the existing traffic and <br />that signalization is needed at the Bishop-Hopkins intersection. In <br />response to Mr. Guerra's question to Mr. Wester, Mr. Wester advised <br />until the traffic concerns of the area are addressed, the Westover area <br />is suggesting there be a rezoning moratorium (of higher density) in <br />this area. No one else wished to speak, so Mayor Younger closed the <br />public hearing. Mr. Guerra moved for adoption of the Zoning Ordinance <br />and Mayor Younger seconded the motion. On roll call the following vote <br />was recorded: <br /> <br />AYE: <br /> <br />Guerra. <br /> <br />NAY: <br /> <br />Brown, Coddington, Farr, Younger, Kissler, Nicola. <br /> <br />ABSTAIN: <br /> <br />None. <br /> <br />The motion failed. <br />
