Joe Wester of the Westover area advised the Council there was already too much traffic until the streets are improved. Mr. Robbins advised the Zoning Commission had approved the request conditionally: with access on to Del Mar and no curb cut on Bishop Street. Mr~ Robbins advised improvements are scheduled for streets in the Westover area in the CIP program in the Spring of 1988. No one else wished to speak in favor or in opposition, so Mayor Younger closed the public hearing. Mr. Guerra moved for adoption of the Zoning Ordinance with the condition that roadway access be only off of Del Mar and Mr. Brown seconded the motion. On roll call the following vote was recorded: AYE: Brown, Guerra, Nicola. NAY: Coddington, Farr, Younger, Kissler. ABSTAIN: None. The motion failed. Mayor Younger introduced a public hearing and adoption of a Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY ZONING BLOCK 10, LOTS D AND E OF SCHNEIDERS REARRANGEMENT OF LOTS 51 AND 52, BLOCK 10 OF THE WESTOVER ADDITION TO THE CITY OF SAN MARCOS AS RECORDED IN VOLUME 4, PAGE 275 OF THE HAYS COUNTY PLAT RECORDS, LOCATED AT THE SOUTH CORNER OF THE IN- TERSECTION OF CLYDE STREET AND BAYLOR STREET, FROM "R-l" (SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]) TO "DP-2" (DUPLEX DISTRICT [MEDIUM DENSITY]); AND DE- CLARING AN EFFECTIVE DATE. Mayor Younger opened the public hearing and asked if anyone wished to speak in favor or in opposition to the zoning request. Laura Schneider stated she was representing Comet Construction. She stated they had the zoning changed to "R-l" some time ago because with the low density land use designation, they thought that is all the property could be zoned. When talking with the Planning Staff, they were advised that "DP-2" zoning was acceptable with the land use designation, so they are now requesting the property be rezoned to "DP-2". Joe Wester representing the Westover area stated the neighborhood is opposed to the City allowing additional duplex zoning, because it would in- crease the traffic more than "R-l" zoning. He stated the Police De- partment does their job in trying to control the traffic on Bishop, but that Bishop is not wide enough to carry the existing traffic and that signalization is needed at the Bishop-Hopkins intersection. In response to Mr. Guerra's question to Mr. Wester, Mr. Wester advised until the traffic concerns of the area are addressed, the Westover area is suggesting there be a rezoning moratorium (of higher density) in this area. No one else wished to speak, so Mayor Younger closed the public hearing. Mr. Guerra moved for adoption of the Zoning Ordinance and Mayor Younger seconded the motion. On roll call the following vote was recorded: AYE: Guerra. NAY: Brown, Coddington, Farr, Younger, Kissler, Nicola. ABSTAIN: None. The motion failed.
