20 Regular Meeting 0 ! ,..- February ~, 1987 , Page II Mr. Farr moved to amend his original motion for adoption of the Ordinance on third and final reading to adopt the Ordinance on third and final reading as amended and with the revisions and Mr. Coddington moved to amend his second in agreement with Mr. Farr. The Council then voted unanimously for adoption of the Ordinance on third and final reading, as amended and with the revisions. Mayor Younger introduced for consideration adoption of an Ordinance on third and final reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, GRANTING THE CONSENT OF THE CITY OF SAN MARCOS TO THE CREATION OF A MUNICIPAL UTILITY DISTRICT: LOWMAN RANCH MUNICIPAL UTILITY DISTRICT, SUBJECT TO VARIOUS TERMS AND CONDITIONS SET FORTH IN A SEPARATE AGREEMENT CONCERNING THE CREATION AND OPERATION OF SAID DISTRICT (CONSENT AGREEMENT) WHICH IS MADE A PART OF THIS ORDINANCE, AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT, AND DECLARING AN EFFECTIVE DATE. Mr. Coddington moved for adoption of the Ordinance on third and final reading and Mr. Farr seconded the motion. Mr. Coddigton moved to amend the Ordinance to add Article Fourteen as read into the record by Mr. Hankins: "Notwithstanding anything in this Agreement to the contrary, this Agreement shall be null and void and of no force and effect unless LRL executes the Agreement regarding development of Lowman Ranch Municipal Utility District approved by the San Marcos City Council on the date of approval of this Agreement." Mr. Farr seconded Mr. Coddington's amendment, which passed unanimously. Mayor Younger moved to amend Section 1.02(a) to read: "Notwithstanding any provision in the Utility District Ordinance to the contrary, the City has agreed to amend its Utility District Ordinance with respect to the following provisions," (and to delete the remaining portion of that sentence), and Mr. Guerra seconded the motion, which passed unanimously. Mayor Younger moved to amend Exhibit nCn as read into the record by Mr. Hankins, which was handed out to the Council in the. meeting as follows: Page 1 - WATER - Major Facilities - .. On roll call the fol- lowing vote was recorded: AYE: Brown, Coddington, Farr, Younger, Kissler, Nicola. NAY: None. ABSTAIN: Guerra.
