<br />194 <br /> <br />Regular Meeting <br /> <br />August 10, 1987 <br /> <br />Page 5 <br /> <br />BE IT ORDERED to BE IT ORDAINED and Mr. Brown seconded the motion, <br />which passed unanimously. Mr. Farr then moved to adopt the Ordinance <br />on emergency as amended and Ms. Kissler seconded the motion, which <br />passed unanimously. <br /> <br />The Council then moved to Item 17 on the Agenda, to hold a portion <br />of the Executive Session as follows. Mr. Brown moved the Council <br />adjourn into Executive Session pursuant to Article 6252-17, §2(e), <br />V.A.C.S., to discuss matters where the duties of the City Attorney <br />to the City pursuant to the Code of Professional Responsibility of <br />the State Bar of Texas clearly conflicts with Article 6252-17, and <br />Ms. Kissler seconded the motion, which passed unanimously (8:27 p.m.) <br /> <br />Mr. Hernandez moved the Council reconvene at 9:21 p.m. and Mr. Brown <br />seconded the motion, which passed unanimously. <br /> <br />The Council then moved to Item 18 on the agenda. Mayor Younger intro- <br />duced for consideration adoption of a Resolution, the caption which <br />was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />~ffiRCOS, TEXAS, RELATING TO THE ISSUANCE OF BONDS BY <br />THE CENTRAL TEXAS HIGHER EDUCATION AUTHORITY, INC.; <br />APPROVING THE ISSUANCE OF SUCH BONDS AND THE USE OF <br />THE PROCEEDS OF SUCH BONDS; AND MAKING CERTAIN FIND- <br />INGS IN CONNECTION THEREWITH. <br /> <br />Mr. Guerra moved to deny adoption of the Resolution and Ms. Kissler <br />seconded the motion, which passed unanimously. It was consensus <br />of Council to direct Staff to prepare the following for the Council's <br />action on the August 24, 1987 Council Meeting: <br /> <br />1. <br /> <br />Adopt a Resolution that provides that (a) the City <br />Council will not approve the issuance of qualified <br />student loan bonds as defined under Section 144 of <br />the Internal Revenue Code of 1986, as amended and (b) <br />the City has terminated its student loan program; <br /> <br />2. <br /> <br />Direct the Board of Directors of CTHEA to amend their <br />articles of incorporation and bylaws to provide for the <br />disposition of CTHEA income as it was provided for prior <br />to the 1987 amendments; and <br /> <br />3. <br /> <br />Direct the Board of Directors of CTHEA to prepare and <br />submit, after review by the City Council, a private let- <br />ter ruling request regarding the disposition of the <br />income of CTHEA. <br /> <br />The Council then returned to Item 9.A. on the agenda. Mayor Younger <br />introduced for consideration approval of an Ordinance on first read- <br />ing, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 13-l/2 OF THE CODE <br />OF ORDINANCES OF SAID CITY BY REPEALING OBSOLETE <br />SECTIONS l3~1/2-3, 13-1/2-4,13-1/2-5, 13-1/2-6 OF <br />SAID CODE AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Guerra moved for approval of the Ordinance on first reading and <br />Ms. Kissler seconded the motion. Mr. Hankins read the following <br />language into the record for amendment: in SECTION 1. at the end <br />of the sentence change the period after repealed to a coma, and the <br />following new Section 13-1/2-3 is adopted: <br />
