<br />32 <br /> <br />Regular Meeting <br /> <br />September 28, 1987 <br /> <br />Page 3 <br /> <br />Mayor Younger introduced for consideration a public hearing and approval <br />of an Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE SAN MARCOS CODE OF ORDIN- <br />ANCES BY THE ADDITION OF CHAPTER 5, ARTICLE V, ENTITLED <br />"PUBLIC RIGHT-OF-~vAY ACCESS ORDINANCE", REGULATING THE <br />SITING, DESIGN AND CONSTRUCTION OF DRIVEWAYS WHICH ACCESS <br />PUBLIC STREETS, BY DEFINING TERMS; REQUIRING CONSTRUCTION <br />PERMITS; AUTHORIZING THE CITY ENGINEER TO DETERMINE THE <br />EFFECTS OF CONSTRUCTION UPON THE RIGHT OF THE PUBLIC TO <br />FREE AND UNHN1PERED PASSAGE OVER PUBLIC STREETS AND SIDE- <br />WALKS AND UPON THE PUBLIC SAFETY, TO DETERMINE THE ADE- <br />QUACY OF CONSTRUCTION MATERIALS, AND TO PROMULGATE DESIGN <br />STANDARDS; SETTING REQUIREMENTS FOR CONTRACTORS; ESTABLISH- <br />ING PERMIT FEES AND PENALTIES; PROVIDING FOR APPEALS; PRO- <br />VIDING FOR SEPARABILITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Younger opened the public hearing and asked if anyone wished to <br />speak in favor or in opposition to the amendment. No one did, so Mayor <br />Younger closed the public hearing. Mr. Brown moved to table first read- <br />ing of the Ordinance until October 12, 1987 and Ms. Kissler seconded <br />the motion, which passed unanimously. A public hearing will be <br />scheduled for the October 12 meeting. <br /> <br />Mayor Younger introduced for consideration a public hearing and approval <br />of an Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THAT ORDINANCE ADOPTED <br />AUGUST 31, 1987, WHICH SET FORTH AN ITEMIZED ESTIM- <br />ATE OF THE EXPENSE OF CONDUCTING EACH ADMINISTRATIVE <br />UNIT OF THE MUNICIPAL GOVERNMENT OF SAID CITY FOR <br />THE FISCAL YEAR BEGINNING OCTOBER 1,1987 AND ENDING <br />ON SEPTEMBER 30, 1988, AND APPROPRIATED MONEY FOR <br />THE VARIOUS FUNDS AND PURPOSES OF SUCH ESTIMATE, TO <br />REVISE SAID ESTIMATES AND TO REAPPROPRIATE SAID FUNDS, <br />ADOPTING SAID REVISIONS AND ESTIMATES, AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Mayor Younger opened the public hearing and asked if anyone wished to <br />speak in favor or in opposition to the amendment. No one did, so Mayor <br />Younger closed the public hearing. Mr. Hernandez moved for approval <br />of the Ordinance on first reading and Mr. Farr seconded the motion. <br />Mr. Gonzalez introduced the Acting District Manager, David Sanders, <br />to the Council. The Council then voted unanimously for approval of <br />the Ordinance on first reading. A public hearing and second reading <br />are scheduled for October 12. <br /> <br />Mayor Younger introduced for consideration a public hearing and approval <br />of an Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING EXHIBITS A AND B TO SECTIONS <br />30-27 AND 30-35, RESPECTIVELY, OF THE CODE OF ORDIN- <br />ANCES OF SAID CITY TO INCREASE THE CHARGES TO BE PAID <br />BY ALL PERSONS OWNING OR OCCUPYING PREMISES WHICH ARE <br />CONNECTED WITH THE WATER SYSTEM OF SAID CITY; TO IN- <br />CREASE THE RATES FOR SERVICES TO USERS OF THE SANITARY <br />SEWAGE SYSTEM OF SAID CITY; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mayor Younger opened the public hearing and asked if anyone wished to <br />speak for or against the Ordinance.
