<br />96 <br /> <br />Regular Meeting <br /> <br />October 26,1987 <br /> <br />Page 3 <br /> <br />Mr. Farr introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 29 OF THE SAN MARCOS <br />CODE OF ORDINANCES BY THE ADDITION OF A TOW-AWAY ZONE <br />ON ALAMO STREET, ORCHARD STREET, AND YALE STREET AND <br />ESTABLISHING AN EFFECTIVE DATE. <br /> <br />Mr. Hernandez moved for approval of the Ordinance on first reading <br />and Ms. Kissler seconded the motion, which passed unanimously. <br /> <br />Mr. Farr introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 29 OF THE SAN MARCOS <br />CODE OF ORDINANCES BY THE ADDITION OF STOP SIGNS ON <br />MEINERS STREET AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />Mr. Hernandez moved for approval of the Ordinance on first reading <br />and Mr. Brown seconded the motion, which passed unanimously. <br /> <br />Mr. Farr introduced for consideration approval of six Ordinances on <br />second reading and adoption of four Ordinances on third and final <br />reading by consensus. Mr. Brown moved for approval of the six Ordin- <br />ances on second reading and four Ordinances on third and final reading <br />by consensus and Mr. Guerra seconded the motion. Mr. Guerra requested <br />the record show Mr. Guerra abstaining to Item 8.A. (4) and Mr. Hernandez <br />requested the record show Mr. Hernandez voting Nay to Item 8.A. (4). <br />Since Item 8.A. (4) would not receive sufficient votes, the Council <br />requested this Item be considered for second reading again on the <br />November 9 Meeting. The caption of this Ordinance will follow all <br />the other Ordinances passed by consensus. The Council voted unanimously <br />for approval and adoption of the Ordinances on consensus, with the <br />deletion of Item 8.A. (4) from consensus. The captions of these <br />Ordinances read as follows: <br /> <br />Approval of Ordinances on second reading: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING APPENDIX A, GENERAL ZONING <br />ORDINANCE, OF THE SAN MARCOS CODE OF ORDINANCES BY <br />EXPANDING THE PURPOSE PROVISIONS OF THE ORDINANCE, <br />CLARIFYING THE METHOD OF CALCULATING THE AREA OF <br />PROTEST FOR ZONING CHANGES, REVISING PROVISIONS FOR <br />DURATION AND RENEWAL OF SPECIFIC USE PERMITS, CLARI- <br />FYING THE DESCRIPTION OF SIGHT-TRIANGLE, ADDING NEW <br />OFF-STREET PARKING REQUIREMENTS, DELETING CURB CUT <br />REQUIREMENTS, AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE SAN MARCOS CODE OF ORDIN- <br />ANCES BY THE ADDITION OF CHAPTER 5 ARTICLE V, ENTITLED <br />"PUBLIC RIGHT-OF-WAY ACCESS ORDINANCE", REGULA,TING <br />THE SITING, DESIGN AND CONSTRUCTION OF DRIVEWAYS WHICH <br />ACCESS PUBLIC STREETS, BY DEFINING TERMS; REQUIRING <br />CONSTRUCTION PERMITS; AUTHORIZING THE CITY ENGINEER <br />TO DETERMINE THE EFFECTS OF CONSTRUCTION UPON THE <br />RIGHT OF THE PUBLIC TO FREE AND UNHAMPERED PASSAGE <br />OVER PUBLIC STREETS AND SIDEWALKS AND UPON THE PUBLIC <br />SAFETY, TO DETERMINE THE ADEQUACY OF CONSTRUCTION MAT- <br />ERIALS, AND TO PROMULGATE DESIGN STANDARDS; SETTING <br />REQUIREMENTS FOR CONTRACTORS; ESTABLISHING PERMIT FEES <br />AND TERMS; EXEMPTING CERTAIN CONSTRUCTION FROM COMPLIANCE; <br />PROVIDING PENALTIES; PROVIDING FOR APPEALS; PROVIDING FOR <br />SEPARABILITY; AND DECLARING AN EFFECTIVE DATE. <br />
