96 Regular Meeting October 26,1987 Page 3 Mr. Farr introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 29 OF THE SAN MARCOS CODE OF ORDINANCES BY THE ADDITION OF A TOW-AWAY ZONE ON ALAMO STREET, ORCHARD STREET, AND YALE STREET AND ESTABLISHING AN EFFECTIVE DATE. Mr. Hernandez moved for approval of the Ordinance on first reading and Ms. Kissler seconded the motion, which passed unanimously. Mr. Farr introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 29 OF THE SAN MARCOS CODE OF ORDINANCES BY THE ADDITION OF STOP SIGNS ON MEINERS STREET AND ESTABLISHING AN EFFECTIVE DATE. Mr. Hernandez moved for approval of the Ordinance on first reading and Mr. Brown seconded the motion, which passed unanimously. Mr. Farr introduced for consideration approval of six Ordinances on second reading and adoption of four Ordinances on third and final reading by consensus. Mr. Brown moved for approval of the six Ordin- ances on second reading and four Ordinances on third and final reading by consensus and Mr. Guerra seconded the motion. Mr. Guerra requested the record show Mr. Guerra abstaining to Item 8.A. (4) and Mr. Hernandez requested the record show Mr. Hernandez voting Nay to Item 8.A. (4). Since Item 8.A. (4) would not receive sufficient votes, the Council requested this Item be considered for second reading again on the November 9 Meeting. The caption of this Ordinance will follow all the other Ordinances passed by consensus. The Council voted unanimously for approval and adoption of the Ordinances on consensus, with the deletion of Item 8.A. (4) from consensus. The captions of these Ordinances read as follows: Approval of Ordinances on second reading: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING APPENDIX A, GENERAL ZONING ORDINANCE, OF THE SAN MARCOS CODE OF ORDINANCES BY EXPANDING THE PURPOSE PROVISIONS OF THE ORDINANCE, CLARIFYING THE METHOD OF CALCULATING THE AREA OF PROTEST FOR ZONING CHANGES, REVISING PROVISIONS FOR DURATION AND RENEWAL OF SPECIFIC USE PERMITS, CLARI- FYING THE DESCRIPTION OF SIGHT-TRIANGLE, ADDING NEW OFF-STREET PARKING REQUIREMENTS, DELETING CURB CUT REQUIREMENTS, AND ESTABLISHING AN EFFECTIVE DATE. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE SAN MARCOS CODE OF ORDIN- ANCES BY THE ADDITION OF CHAPTER 5 ARTICLE V, ENTITLED "PUBLIC RIGHT-OF-WAY ACCESS ORDINANCE", REGULA,TING THE SITING, DESIGN AND CONSTRUCTION OF DRIVEWAYS WHICH ACCESS PUBLIC STREETS, BY DEFINING TERMS; REQUIRING CONSTRUCTION PERMITS; AUTHORIZING THE CITY ENGINEER TO DETERMINE THE EFFECTS OF CONSTRUCTION UPON THE RIGHT OF THE PUBLIC TO FREE AND UNHAMPERED PASSAGE OVER PUBLIC STREETS AND SIDEWALKS AND UPON THE PUBLIC SAFETY, TO DETERMINE THE ADEQUACY OF CONSTRUCTION MAT- ERIALS, AND TO PROMULGATE DESIGN STANDARDS; SETTING REQUIREMENTS FOR CONTRACTORS; ESTABLISHING PERMIT FEES AND TERMS; EXEMPTING CERTAIN CONSTRUCTION FROM COMPLIANCE; PROVIDING PENALTIES; PROVIDING FOR APPEALS; PROVIDING FOR SEPARABILITY; AND DECLARING AN EFFECTIVE DATE.
