109 MINUTES OF THE EMERGENCY MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, NOVEMBER 2, 1987 PRESENT: Mayor J. E. Younger Mayor Pro-Tern Council Members Gerald G. Farr Karl W. Brown Fred Guerra Rick Hernandez Betty Jane Kissler * William C. Nicola City Manager City Secretary City Attorney Assistant City Manager A. C. Gonzalez Janis K. Womack Lamar W. hankins Larry Gilley Also Present: Mark Hendricks, Henry Krause, Bill Fly, Patty Sullivan, Robert Hardesty, Hugh Snellings, Jay Moore, Bill Coddington, Cindy Rodriguez, Patsy Greiner, Melissa Millecam, Randall Morris, Patty Wenk, John McCrocklin, Kathy Morris, Bruce Harper, Bill Plummer and others. Mayor Younger called the meeting to order at 11:00 a.m. Mayor Younger stated the Council was setting some rules for conducting this meeting. He stated the Council would adjourn into Executive Ses- sions for a short period and any of the CTHEA Board Members who wished to make a statement to the Council at that time could do so. He stated any Board Members who did not wish to make a private statement could make their statement in public. He stated the City's letter to the Board Members outlined the reason for the Council's action. He stated this would not be a public hearing and the Council would only allow Board Members the right to speak; the Council would not answer any questions from the Board Members or any of the audience until the re- moval proceedings were completed and the new Board Members appointed. Kathy Morris asked Mayor Younger if they were being denied a public hearing and when would they have a public hearing. Mayor Younger stated they would have a public hearing in about five minutes unless there were a number of the Members who wanted private hearings. Mr. Fly stated he had a recent conversation with Mr. Hankins and requested permission to bring that information to the Council. Mayor Younger requested Mr. Fly pass the information to Mr. Hankins. Mr. Guerra moved the Council adjourn into Executive Session pursuant to Article 6252-17, §2(g), V.A.C.S., with respect to the dismissal of public officers and pursuant to Article 6252-17, §2(e), V.A.C.S., to seek the City Attorney's advice with respect to matters where the du- ties of the City Attorney to the City pursuant to the Code of Profes- sional Responsibility of the State Bar of Texas clearly conflicts with Article 6252-17, and Mr. Hernandez seconded the motion, which passed unanimously (Mr. Nicola present to vote on this item - 11:02 a.m. - adjourned at 11:04 a.m.). Mr. Hernandez moved the Council reconvene at 11:41 a.m. and Ms. Kissler seconded the motion, which passed unanimously (Mr. Nicola not present to vote on this item). Mayor Younger stated the Council wculd now allow the Board Members to make their statements, and named Patty Sullivan, and requested she come to the podium to make her statement.
