<br />110 <br /> <br />Emergency Meeting <br /> <br />November 2, 1987 <br /> <br />Page 2 <br /> <br />Counsel for the Authority~ and he stated Mrs. Sullivan and some of <br />the other Members of the Board had asked him to express their reluct- <br />ance to speak to the Council at this time, because they had not re- <br />ceived the required notice under the Open Meetings Act for an open <br />meeting concerning their statements. Mayor Younger asked how many <br />Members did not wish to speak at this time, to which Mr. Fly respond- <br />ed he thought it was unanimous that the Board wanted a public hearing <br />and all wanted to present their statements at that time. Mayor Younger <br />stated the Members of the Board that are subject to be replaced at this <br />meeting could make their statements at this time. Mr. Hankins advised <br />that Item 4 on the Agenda provides for the Council to consider the <br />removal of members of the CTHEA Board and conduct other proceedings <br />related thereto, as necessary, and a public hearing in this situation <br />would be another proceeding since they have declined the opportunity <br />to have a closed hearing. Kathy Morris stated she was a member of the <br />Board of CTHEA and that they had requested a public hearing and had a <br />right to that public hearing. She stated the Council notified them two <br />hours prior to this meeting that it would be held, and that the majority <br />of the CTHEA Board are working and not able to be present and wanted to <br />know why the Council would not allow them a public hearing at a later <br />date with a 72-hour notice. Mayor Younger stated the Council will go <br />forward with the removal of 6 of the CTHEA Board Members and that they <br />were welcome to make a statement at this time. Mayor Younger stated <br />there would be another Council Meeting at 6:00 p.m. this same date and <br />if they wanted to wait and make a statement at that time, they could, <br />but they would already have been removed from the Board (the six Members <br />notified this morning). Kathy Morris stated the CTHEA Members were <br />asked to come with evidence as to why they should serve on this Board <br />and she requested the Council provide information why they should be <br />removed from the Board. Mayor Younger stated he had a statement he <br />wished to read, which is a portion of the reason why the Board is <br />being removed. "No responsible sponsoring organization would accept <br />from one of its creations the active hostility and ill will demonstrated <br />frequently during the past few months by some CTHEA Board Members and the <br />Executive Director. To allow such activity to continue may result in <br />additional harm to the City's reputation and finances. The time has <br />come for the City Council to register its dissatisfaction with the <br />events described above and fulfill its duties to the citizens of San <br />Marcos by removing those Board Members who are unwilling to cooperate <br />with the Council and City Staff. It is for these reasons the City <br />Council with much regret has taken the action of removing Members of <br />the CTHEA Board who have served in recent months. We hope and anticipate <br />that a new Board will move forward in a spirit of cooperation and colla- <br />boration to help the City resolve the issues which are before it." Mayor <br />Younger stated the Board Members were given a letter October 30 and the <br />letter stated the Council no longer had confidence in the Board's willing- <br />ness to continue to serve in a manner which serves the best interest of <br />the City of San Marcos. He stated the Council had hoped the Board would <br />begin cooperating but that had not been forthcoming. For that reason <br />the Council was considering their removal. He stated the letter six <br />of the Members received today's date states the reason for the 11:00 <br />a.m. meeting is the Council's concern about the assets far into the <br />future of CTHEA. Kathy Morris stated she thought that was accusatory <br />and that the CTHEA Board had conformed with what the Council has re- <br />quested and had tried to communicate with the Council and that the <br />CTHEA Board has the best interest in mind for a different reason than <br />the Council. She stated they had tried to fulfill their obligations <br />with what they think is best to do and took an oath to do so. She <br />stated they needed to have a public hearing to express their opinions <br />and that the action of the Council is deplorable. Patty Sullivan stated <br />she is speaking under protest, because she felt the Council was acting <br />
