Gilley <br />Robbins <br /> <br />Also Present: Dan Gibson, Jana Green, Kelly Kilber, Jay Moore, Stanley <br />Hughson, Patty Wenk, Judy Mitchell and others. <br /> <br />Mayor Younger called the meeting to order at 6:30 p.m. <br /> <br />Mayor Younger introduced a discussion of an Ordinance amending the <br />General Zoning Ordinance to provide for a voluntary residential trans- <br />fer of development rights. Mr. Robbins advised the amendment was re- <br />commended by the Planning and Zoning Commissions. Mr. Robbins advised <br />no zoning application had been received from the granting zone (green <br />area shown on projector), and that the land use amendment and two zoning <br />ordinances before the Council and Planning and Zoning Commissions needed <br />to be acted upon simultaneously to effect the transfer. Before the <br />land use amendment and zoning ordinances can be acted upon, the trans- <br />fer of development rights amendment to the General Zoning Ordinance <br />must be adopted. Mr. Robbins stated he does not recommend the City <br />ever initiate the TDR Ordinance as written. Mr. Gonzalez stated the <br />property owner would be responsible for initiating the TDR Ordinance <br />with the exception of City-owned property. Mayor Younger asked if <br />we could make changes to the map if they are not in place now (Section <br />40.100.101., and Mr. Robbins stated this Section allows that. Mr. <br />Robbins stated this Ordinance is for voluntary purposes. Mr. Hankins <br />stated the Council will have the choice to accept or reject a transfer <br />in the voting procedure. The owner would have to transfer by deed or <br />easement. Mr. Millecam stated the Planning Commission had had some <br />concern for the City's protection from a person going to court regard- <br />ing remuneration, and Mr. Hankins responded the City is protected with <br />the requirement of a deed or easement. Mr. Millecam advised that <br />Part 3 of the TDR Ordinance gives the City an option to see what kind <br />of zoning the City wants. <br /> <br />* Mr. Guerra present at 6:39 p.m~; ** Dr. Rogers present at 7:00 p.m. <br />*** Messrs.
