(9) International Fire Code 2009 2015 Edition, including Appendices B, D, E, F, G, I and J. <br />(10) International Swimmina Pool and Spa Code 2015 Edition. <br />(11) International Existing Building Code 2015 Chapter 4 <br />(b) If there is a conflict between a state law and an adopted code or this chapter, then the state law will take <br />precedence. In cases of conflicts between a provision of the San Marcos Code and these adopted codes, the <br />provision of the San Marcos Code will take precedence. Otherwise, all structures shall be designed, built, and <br />maintained in accordance with these adopted codes. <br />(c) Local amendments to these adopted codes are contained in Articles 2, 3, 5, 6, 7 8, 9, 10, 11,-ax4 12 and 13 which <br />are attached to the ordinance from which this article was derived and incorporated herein by reference. `=1 <br />(d) Any reference to the existing building code should be considered to mean the 2015 International Building Code <br />with Appendices and local amendments adopted herein. <br />Sec. 14.003. - Building inspection division. <br />The building inspection division is established within the #Planning and 4Development sServices 4Department. <br />This division will be supervised by the building official. The building official is appointed by the 4Director of Planning <br />and D4evelopment Sservices. The building official may designate a person to perform the duties and exercise the <br />authority of the building official during the official's absence. <br />Sec. 14.004. - Restrictions on employees. <br />(a) In addition to the restrictions contained in the Ceity Code of Ethics and employee handbook, employees of the <br />building inspection division may not have a financial interest in any construction activity within the city limits <br />or the city's extraterritorial jurisdiction. The term "construction activity" includes: <br />(1) The preparation of plans, specifications or cost estimates for any construction work; <br />(2) The furnishing of labor, materials or supplies for any construction work; <br />(3) The provision of maintenance or repair services, or replacement parts, supplies, equipment or appliances <br />for any existing structure; <br />(4) The provision of construction consulting or project management services; and <br />(5) The provision of real estate inspection services. <br />(b) This restriction will not extend to an employee's interest in a residence owned and occupied by the employee as <br />a homestead. An employee may not be involved in the plan review, permit issuance or inspections of any <br />construction work on the employee's homestead. <br />Sec. 14.005. - Records. <br />The building official will cause a record to be kept of the business of the division. These records will be <br />maintained in accordance with Ceity record retention requirements, and will be subject to public inspection under the <br />Ceity's open records policy. <br />Sec. 14.006. - Fees and exemptions from fees. <br />(a) All fees in this chapter are established by Ceity Ceouncil. <br />(b) The following entities shall be exempt from all fees imposed under this chapter: <br />(1) Non-profit organizations receiving funds frefii all fees the e ty hrough the Ceity's Community <br />Development Block Grant or Human Services programs; <br />(2) The Ceity when using Ceity employees on a construction project of the Ceity; <br />(3) Contractors hired by the Ceity to work on construction projects of the Ceity; <br />Page 2 <br />
