<br /> 2 <br /> Special Meeting May 19, 1993 Page 2 <br /> Chairman Borm introduced a discussion to consider approval of the <br /> supplemental electric service agreement with Southwest Texas state <br /> University. Mayor Morris asked if this was as received in the <br /> packet or if there have been any alterations since May 14. Mr. <br /> Gilley stated there have been no alterations since the packet was <br /> published. Mr. Younger questioned the location of the metering <br /> device. He felt the metering device should be on SMEU property <br /> instead of campus property, and that we set aside a fee for meter <br /> checks to the supplemental service contract. Mr. Younger stated <br /> the supplemental service contract does not set out any of the rates <br /> other than the availability rate. The other items in that should <br /> they have figures set for that, Mr. Saffer stated no, those are a <br /> direct pass through of our wholesale power costs adjusted upward by <br /> one percent. Mr. Saffer stated with respect to the metering <br /> location. We have with our terms and conditions for all customers <br /> that at our request they will make available to us, on their <br /> property suitable space and location for the installation of our <br /> meters. The locations of the meters are set at our convenience <br /> where we want and need them. Many times we set them at a <br /> particular location on the customer premises because to move them <br /> back on to our facilities would require additional investment. Mr. <br /> Saffer stated as far as meter testing the provisions in this <br /> contract are supposed to be exactly like the provisions in our <br /> Rules and Regulations. Mr. Younger asked if this.. would be the <br /> $15.00 fee set for the others. Mr. Saffer stated with the <br /> University it would be whatever the cost is. There was no further <br /> discussion. Mr. Younger moved to recommend to the City Council <br /> the approval of the Supplemental Electric Service Agreement with <br /> Southwest Texas State University and Mr. Thornton seconded the <br /> motion, which passed unanimously. <br /> Chairman Borm introduced a discussion to consider approval of <br /> refunds in the amount of $267,763.77 to Southwest Texas state <br /> University due to the elimination of demand ratchet provision of <br /> Rate Schedule LGS and recommendation to Council. Mr. Hart asked to <br /> be provided with an overview of this item. Mr. Saffer stated back <br /> in 1990 we met with Mr. Fauver of the University, one of the <br /> biggest complaints that they had was the ratchet provision of the <br /> LGS rate schedule. When we came to you with the Schedule COG we <br /> recommended that you forgive the ratchet provision back for a year <br /> until September, (which would be August consumption) as a <br /> concession to the whole package. Mr. Saffer stated was there any <br /> cost justification for it, yes because if we had used schedule COG <br /> for that period SWT would have paid even less. Mr. Thornton moved <br /> to recommend to the City Council to approve refunds in the amount <br /> of $267,763.77 to Southwest Texas State University, Mr. Cruz <br /> seconded, the motion passed unanimously. Mr. Saffer stated the <br /> proposal was that if we approve the refund that it be refunded back <br /> over a twelve month period as billing credits, not as a cash <br /> refund. Chairman Borm questioned when this would begin. Mr. <br /> Saffer stated beginning the first month that they are billed under <br /> schedule COG as soon as we get a signed contract from them and <br /> everything is ready to bill them. <br /> Chairman Borm introduced a discussion and recommendation of SMEU <br /> participation in TPPA Public Information and Awareness Advertising <br /> Program. Mayor Morris stated a year or two ago TPPA proposed <br /> generic public information series about public power. Having seen <br /> the advertising they are going to do, she felt it would assist all <br /> of us because it does give us a prospective of public power as <br /> being consumer owned power. Mayor Morris stated this is going to <br /> happen whether we participate in this or not. Chairman Borm asked <br /> where will the San Marcos area see these. Mayor Morris stated on <br /> Austin channels for sure. Mayor Morris stated that TPPA would be <br /> happy to make a presentation if the SMEU Board wants it. Chairman <br /> Borm stated that she recommends that we pay our fair share of the <br /> contribution. Mayor Morris asked if this could come out of our <br /> ---- <br />
