3 Regular Meeting August 9, 1993 Page 3 Mr. Plummer opened the public hearing and asked if anyone wished to speak for or against the zoning amendment. No one did, so Mr. Plummer closed the public hearing. Mr. Moore moved for adoption of the Zoning Ordinance and Mr. Cox seconded the motion. On roll call the following vote was recorded: AYE: Moore, Mooney, Cox, Plummer. NAY: None. ABSTAIN: Hart, Guerra. Mr. Plummer introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: .' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ESTABLISHING A FRANCHISE AGREEMENT BETWEEN THE CITY AND THE BLUEBONNET ELECTRIC COOPERATIVE, INC. FOR THE PROVISION OF ELECTRICAL SERVICE WITHIN A PORTION OF THE CITY FOR A PERIOD OF TEN YEARS, AND THAT THE CITY OF SAN MARCOS SHALL RECEIVE A QUARTERLY FRANCHISE FEE FOR SUCH USE, PROVIDING FOR INDEMNIFICATION OF THE CITY OF SAN MARCOS, AND DECLARING AN EFFECTIVE DATE. ~ Mr. Moore moved for approval of the Ordinance on first reading and Mr. Hart seconded the motion. The Council was advised the annual fee would be $25,000.00 or 2% of gross receipts, whichever is greater. Mr. Guerra expressed concern the City was not asking enough in the franchise agreement and wants to know what 2% would yield. The Council voted unanimously for approval of the Ordinance on first reading. Mr. Plummer introduced for consideration reconsideration of two Zoning Ordinances. The Council did' not wish to reconsider either ordinance. VERAMENDI LEAGUE NO. 2, IN HAYS COUNTY, TEXAS, LOCATED AT 1210 OLD MARTINDALE ROAD, FROM IIPD" (PRE-DEVELOPMENT DISTRICT) TO "R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]); AND DECLARING AN EFFECTIVE DATE. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING LOT 7, BLOCK 2 OF THE C. L. MCGEHEE SUBDIVISION AS RECORDED IN VOLUME H, PAGE 573 OF THE HAYS COUNTY DEED RECORDS, LOCATED AT 317 BLANCO STREET, FROM "R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]) TO "P/' (PUBLIC AND INSTITUTIONAL DISTRICT) AND DECLARING AN EFFECTIVE DATE. Mr. Plummer introduced for consideration approval of minutes of the Regular Meeting held July 26, 1993, approval of five Ordinances on second reading, adoption of one Ordinance on third and final reading, and adoption of five Resolutions on consensus. Mr. Guerra moved for approval of the minutes of the Regular Meeting held July 26, 1993, for approval of the five Ordinances on second reading, for adoption of the Ordinance on third and final reading and adoption of the five Resolutions on consensus and Mr. Hart seconded the motion, which passed unanimously. The captions of the Ordinances and Resolutions read as follows: Approval of Ordinances on second reading: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOSI TEXAS, CHANGING THE NAME OF SOUTH EDWARD GARY STREET BETWEEN EAST MARTIN LUTHER KING, JR.
