<br />22 <br />Regular Meeting November 8, 1993 Page 2 <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak for or against the land use amendment. No one did, so Mayor <br />Morris closed the public hearing. Mr. Plummer moved for adoption of <br />the Resolution and Mr. Hart seconded the motion, which passed <br />unanimously. <br />Mayor Morris introduced for consideration a public hearing and <br />adoption of a Zoning Ordinance, the caption which was read as <br />follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING THE OFFICIAL, ZONING MAP OF THE CITY BY REZONING <br /> 0.146 AND 0.213 ACRE TRACTS OUT OF BLOCK 13 IN THE LINDSEY & <br /> HARVEY ADDITION, CITY OF SAN MARCOS, HAYS COUNTY, TEXAS, <br /> LOCATED AT 325 AND 329 NORTH STREET, FROM "MF-4" (MULTI-FAMILY <br /> DISTRICT [HIGH DENSITY]) TO "P" (PUBLIC AND INSTITUTIONAL <br /> DISTRICT) AND DECLARING AN EFFECTIVE DATE. <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Morris closed the public hearing. Mr. <br />Cox moved for adoption of the Zoning Ordinance and Mr. Plummer <br />seconded the motion, which passed unanimously. <br /> ~ <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER <br /> 23, PUBLIC UTILITIES, OF THE SAN MARCOS CODE OF ORDINANCES TO <br /> ADD AN ARTICLE IV, CABLE TELEVISION RATES; PRESCRIBING <br /> REGULATIONS FOR RATES CHARGED TO CABLE TELEVISION SUBSCRIBERS <br /> FOR THE BASIC SERVICE TIER; PROVIDING THAT THIS ORDINANCE IS <br /> CUMULATIVE OF CERTAIN LAWS AND REPEALING OTHERS; PROVIDING FOR <br /> SEVERABILITY; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION; <br /> AND PROVIDING AN EFFECTIVE DATE~ <br />Mr. Moore moved for approval of the Ordinance on first reading and <br />Mr. Hart seconded the motion. Mayor Morris moved to amend the <br />Ordinance to adopt the Ordinance on emergency rather than three <br />readings as follows, "SECTION 5. That the importance of this <br />ordinance and the imminent expiration of a rate freeze imposed upon <br />cable operators by the Federal Communications Commission create an <br />emergency and an imperative public necessity so that the provisions <br />of the Charter requiring that ordinances shall be presented at three <br />separate meetings and that no ordinance shall become effective until <br />the expiration of ten (10) days following the date of its final <br />passage be suspended, and these provisions are hereby suspended, and <br />this Ordinance shall take effect on November 14, 1993, and after <br />notice of its adoption is published in a newspaper of general <br />circulation in the city as provided by the Charter," and Mr. Moore <br />seconded the motion, which passed unanimously. The Council then <br />voted unanimously for adoption of the Ordinance on emergency, as <br />amended. <br />Mayor Morris introduced for consideration reconsideration of.a <br />Zoning Ordinance. The Council did not wish to reconsider the <br />Ordinance. The caption of the Ordinance reads as fol+ows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br /> 0.54 ACRES, MORE OR LESS, OF LAND AREA IN THE J. M. VERAMENDI <br /> LEAGUE NO. TWO, CITY OF SAN MARCOS, HAYS COUNTY, TEXAS, LOCATED <br /> AT 639 HOPKINS STREET, FROM "M" (MULTI~FAMILY, DUPLEX AND <br /> NEIGHBORHOOD BUSINESS DISTRICT) TO "c" (COMMERCIAL DISTRICT) <br /> AND DECLARING AN EFFECTIVE DATE.. <br />Mayor Morris introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br />
