No one did, so Mayor Morris closed the public hearing. Mr. Plummer moved for adoption of the Resolution and Mr. Hart seconded the motion, which passed unanimously. Mayor Morris introduced for consideration a public hearing and adoption of a Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL, ZONING MAP OF THE CITY BY REZONING 0.146 AND 0.213 ACRE TRACTS OUT OF BLOCK 13 IN THE LINDSEY & HARVEY ADDITION, CITY OF SAN MARCOS, HAYS COUNTY, TEXAS, LOCATED AT 325 AND 329 NORTH STREET, FROM "MF-4" (MULTI-FAMILY DISTRICT [HIGH DENSITY]) TO "P" (PUBLIC AND INSTITUTIONAL DISTRICT) AND DECLARING AN EFFECTIVE DATE. Mr. Cox moved for adoption of the Zoning Ordinance and Mr. Plummer seconded the motion, which passed unanimously. ~ Mayor Morris introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 23, PUBLIC UTILITIES, OF THE SAN MARCOS CODE OF ORDINANCES TO ADD AN ARTICLE IV, CABLE TELEVISION RATES; PRESCRIBING REGULATIONS FOR RATES CHARGED TO CABLE TELEVISION SUBSCRIBERS FOR THE BASIC SERVICE TIER; PROVIDING THAT THIS ORDINANCE IS CUMULATIVE OF CERTAIN LAWS AND REPEALING OTHERS; PROVIDING FOR SEVERABILITY; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE~ Mr. Moore moved for approval of the Ordinance on first reading and Mr. Hart seconded the motion. Mayor Morris moved to amend the Ordinance to adopt the Ordinance on emergency rather than three readings as follows, "SECTION 5. That the importance of this ordinance and the imminent expiration of a rate freeze imposed upon cable operators by the Federal Communications Commission create an emergency and an imperative public necessity so that the provisions of the Charter requiring that ordinances shall be presented at three separate meetings and that no ordinance shall become effective until the expiration of ten (10) days following the date of its final passage be suspended, and these provisions are hereby suspended, and this Ordinance shall take effect on November 14, 1993, and after notice of its adoption is published in a newspaper of general circulation in the city as provided by the Charter," and Mr. Moore seconded the motion, which passed unanimously. The Council then voted unanimously for adoption of the Ordinance on emergency, as amended. Mayor Morris introduced for consideration reconsideration of.a Zoning Ordinance. The Council did not wish to reconsider the Ordinance. The caption of the Ordinance reads as fol+ows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING 0.54 ACRES, MORE OR LESS, OF LAND AREA IN THE J. M. VERAMENDI LEAGUE NO. TWO, CITY OF SAN MARCOS, HAYS COUNTY, TEXAS, LOCATED AT 639 HOPKINS STREET, FROM "M" (MULTI~FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT) TO "c" (COMMERCIAL DISTRICT) AND DECLARING AN EFFECTIVE DATE.. Mayor Morris introduced for consideration adoption of a Resolution, the caption which was read as follows:
