<br />Regular Meeting <br /> <br />October 11, 1993 <br /> <br />Page 3 <br /> <br /> <br />110 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />LOT 29, BLOCK 2 OF THE WESTOVER ADDITION TO THE CITY OF SAN <br />MARCOS AS RECORDED IN VOLUME 59, PAGE 184 OF THE HAYS COUNTY <br />DEED RECORDS, LOCATED AT 1400 CLYDE STREET, FROM "M" <br />(SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT) TO <br />"DP-2" (TWO-FAMILY DWELLING DISTRICT [MEDIUM DENSITY]) AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />AN 8.8526 ACRE TRACT OF LAND OUT OF THE J. M. VERAMENDI LEAGUE <br />NUMBER 2, IN HAYS COUNTY, TEXAS, LOCATED AT 1005 RIVER ROAD, <br />FROM "R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]) TO <br />"MH" (MOBILE HOME DISTRICT) AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Morris introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, NOMINATING A CANDIDATE FOR THE BOARD OF DIRECTORS OF THE <br />HAYS COUNTY APPRAISAL DISTRICT FOR THE PERIOD BEGINNING JANUARY <br />1, 1994; DIRECTING THE MAYOR TO SUBMIT THE NAME OF THE NOMINEE <br />TO THE CHIEF APPRAISER OF THE HAYS COUNTY APPRAISAL DISTRICT; <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />The Council delayed consideration of this item until later in the <br />meeting (see page 6). <br /> <br />Mayor Morris introduced for consideration reconsideration of <br />Revolving Loan Fund Program award to J & W Donuts in the amount of <br />$12,500.00. Mr. Guerra moved to reconsider and Mr. Mooney seconded <br />the motion, which passed unanimously. Mr. Hart moved to award <br />$12,500.00 to J & W Donuts and Mr. Cox seconded the motion. It was <br />brought to the City's attention Mr. Spencer was in business in San <br />Marcos years ago and defaulted on a loan to Ed Tarbutton. The <br />purpose of the RLF Program is to put people to work and to provide <br />gap financing that banks do not fund. The Council directed Staff to <br />get credit reports in the future on applicants. The Council stated <br />they want credit checks made and the capability of applicants to <br />financially be able to pay loans prior to awards being made. Mayor <br />Morris moved to table this matter to the next meeting for Council to <br />receive the financial information requested and Mr. Hart seconded <br />the motion. On roll call the following vote was recorded: <br /> <br />AYE: Mooney, Hart, Morris, Cox. <br /> <br />NAY: Guerra. <br /> <br />ABSTAIN: None. <br /> <br /> <br />Mayor Morris introduced for consideration approval of the minutes of <br />the Regular Meeting held September 27, 1993, approval of an <br />Ordinance on second reading, adoption of eight Resolutions and award <br />of bid for the sale of city-owned Lot 3, Block 6 of victory Gardens <br />Addition, section I, to Albert and Mary De La Rosa in the amount of <br />$2,000.00 on consensus. The Council removed Items 12.C.(1), (3), <br />(5), (6) and (8) to be considered separately. Mr. Hart moved for <br />approval of the minutes of the Regular Meeting held September 27, <br />1993, approval of the Ordinance on second reading, adoption of the <br />remaining three Resolutions and approval for the sale of city <br />property to the De La Rosas on consensus and Mr. Mooney seconded the <br />motion, which passed unanimously. The captions of the Ordinance and <br />Resolutions read as follows: <br /> <br />Approval of Ordinance on second reading: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, UPDATING AND CLARIFYING CHAPTER 26, TAXATION, OF THE SAN <br />MARCOS CODE OF ORDINANCES; PROVIDING FOR SEVERABILITY; <br />REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; <br />PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. <br />
