Regular Meeting October 11, 1993 Page 3 110 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING LOT 29, BLOCK 2 OF THE WESTOVER ADDITION TO THE CITY OF SAN MARCOS AS RECORDED IN VOLUME 59, PAGE 184 OF THE HAYS COUNTY DEED RECORDS, LOCATED AT 1400 CLYDE STREET, FROM "M" (SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT) TO "DP-2" (TWO-FAMILY DWELLING DISTRICT [MEDIUM DENSITY]) AND DECLARING AN EFFECTIVE DATE. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING AN 8.8526 ACRE TRACT OF LAND OUT OF THE J. M. VERAMENDI LEAGUE NUMBER 2, IN HAYS COUNTY, TEXAS, LOCATED AT 1005 RIVER ROAD, FROM "R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]) TO "MH" (MOBILE HOME DISTRICT) AND DECLARING AN EFFECTIVE DATE. Mayor Morris introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, NOMINATING A CANDIDATE FOR THE BOARD OF DIRECTORS OF THE HAYS COUNTY APPRAISAL DISTRICT FOR THE PERIOD BEGINNING JANUARY 1, 1994; DIRECTING THE MAYOR TO SUBMIT THE NAME OF THE NOMINEE TO THE CHIEF APPRAISER OF THE HAYS COUNTY APPRAISAL DISTRICT; AND DECLARING AN EFFECTIVE DATE. The Council delayed consideration of this item until later in the meeting (see page 6). Mayor Morris introduced for consideration reconsideration of Revolving Loan Fund Program award to J & W Donuts in the amount of $12,500.00. Mr. Guerra moved to reconsider and Mr. Mooney seconded the motion, which passed unanimously. Mr. Hart moved to award $12,500.00 to J & W Donuts and Mr. Cox seconded the motion. It was brought to the City's attention Mr. Spencer was in business in San Marcos years ago and defaulted on a loan to Ed Tarbutton. The purpose of the RLF Program is to put people to work and to provide gap financing that banks do not fund. The Council directed Staff to get credit reports in the future on applicants. The Council stated they want credit checks made and the capability of applicants to financially be able to pay loans prior to awards being made. Mayor Morris moved to table this matter to the next meeting for Council to receive the financial information requested and Mr. Hart seconded the motion. On roll call the following vote was recorded: AYE: Mooney, Hart, Morris, Cox. NAY: Guerra. ABSTAIN: None. Mayor Morris introduced for consideration approval of the minutes of the Regular Meeting held September 27, 1993, approval of an Ordinance on second reading, adoption of eight Resolutions and award of bid for the sale of city-owned Lot 3, Block 6 of victory Gardens Addition, section I, to Albert and Mary De La Rosa in the amount of $2,000.00 on consensus. The Council removed Items 12.C.(1), (3), (5), (6) and (8) to be considered separately. Mr. Hart moved for approval of the minutes of the Regular Meeting held September 27, 1993, approval of the Ordinance on second reading, adoption of the remaining three Resolutions and approval for the sale of city property to the De La Rosas on consensus and Mr. Mooney seconded the motion, which passed unanimously. The captions of the Ordinance and Resolutions read as follows: Approval of Ordinance on second reading: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, UPDATING AND CLARIFYING CHAPTER 26, TAXATION, OF THE SAN MARCOS CODE OF ORDINANCES; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE.
