44 Regular Meeting September 13, 1993 Page 2 Mayor Morris introduced for consideration approval of three appointments to the Human Services Advisory Board. Mr. Moore moved to reappoint Karen Brown, reappoint Shirley Robinson and reappoint Lorine Burleson, which passed unanimously. Mayor Morris introduced a public hearing regarding the San Marcos Revolving Loan Fund Program. Mr. Moore stated he would abstain from - discussion of this item, because he is working on the application. Mayor Morris opened the public hearing and asked if anyone wished to speak. No one did, so Mayor Morris closed the public hearing. Mayor Morris introduced a public hearing and adoption of a Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING 3.69 ACRES OF LAND, MORE OR LESS, OUT OF THE J. M. VERAMENDI LEAGUE NO.2, ABSTRACT NO. 17, IN HAYS COUNTY, TEXAS, LOCATED ON THE SOUTHEAST SIDE OF THE 600 BLOCK OF CHEATHAM STREET, FROM "C" (COMMERCIAL DISTRICT) TO "PH (PUBLIC AND INSTITUTIONAL DISTRICT) AND DECLARING AN EFFECTIVE DATE. Mayor Morris opened the public hearing and asked if anyone wished to speak. No one did, so Mayor Morris closed the public hearing. Mr. Moore moved for adoption of the Zoning Ordinance and Mr. Plummer seconded the motion, which passed unanimously. The Council moved to 9.A. and B. on the agenda. Mayor Morris introduced for consideration adoption of an Ordinance on third and final reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CITY'S ELECTRIC UTILITY TARIFFS TO INCREASE THE RATES FOR CERTAIN CUSTOMER CLASSIFICATIONS; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. Mr. Moore moved for adoption of the Ordinance on third and final reading and Mr. Mooney seconded the motion. Mr. Plummer moved to amend the Ordinance to attach a Revised Appendix Rate Schedule and Mr. Moore seconded the motion, which passed unanimously. The Council then voted unanimously for adoption of the Ordinance on third and final reading. Mayor Morris introduced for consideration adoption of an Ordinance on third and final reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ESTABLISHING A FRANCHISE AGREEMENT BETWEEN THE CITY AND THE BLUEBONNET ELECTRIC COOPERATIVE, INC. FOR THE PROVISION OF ELECTRICAL SERVICE WITHIN A PORTION OF THE CITY FOR A PERIOD OF TEN YEARS, AND THAT THE CITY OF SAN MARCOS SHALL RECEIVE A QUARTERLY FRANCHISE FEE FOR SUCH USE, PROVIDING FOR INDEMNIFICATION OF THE CITY OF SAN MARCOS, AND DECLARING AN EFFECTIVE DATE. Mr. Moore moved for adoption of the Ordinance on third and final reading and Mr. Mooney seconded the motion. Mayor Morris moved to amend the Ordinance on Page 4 as follows: in Section 9 to read, ". . . term of this Agreement an amount [deletion] annually equal to three percent ll!l . . . ." "Provided, that if Bluebonnet. . . Bluebonnet shall be obligated to pay that same percentage to the City under this franchise agreement [deletion]." And to amend on Page 6 as follows: Delete section 16 and renumber section 17 to Section 16, and the new section 16 to read as follows, "Bluebonnet shall have thirty (30) days. . . and being in force and effect from and after July lL 1993 [deletion] and shall effectuate. . . .," and Mr. Moore seconded the motion, which passed unanimously (Mr. Hart present to vote on this item - 7:52 p.m.). The Council voted unanimously for adoption of the Ordinance on third and final reading.
