Mr. Moore moved <br />to reappoint Karen Brown, reappoint Shirley Robinson and reappoint <br />Lorine Burleson, which passed unanimously. <br /> <br />Mayor Morris introduced a public hearing regarding the San Marcos <br />Revolving Loan Fund Program. Mr. Moore stated he would abstain from - <br />discussion of this item, because he is working on the application. <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Morris closed the public hearing. <br /> <br />Mayor Morris introduced a public hearing and adoption of a Zoning <br />Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />3.69 ACRES OF LAND, MORE OR LESS, OUT OF THE J. M. VERAMENDI <br />LEAGUE NO.2, ABSTRACT NO. 17, IN HAYS COUNTY, TEXAS, LOCATED <br />ON THE SOUTHEAST SIDE OF THE 600 BLOCK OF CHEATHAM STREET, FROM <br />"C" (COMMERCIAL DISTRICT) TO "PH (PUBLIC AND INSTITUTIONAL <br />DISTRICT) AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Morris closed the public hearing. Mr. <br />Moore moved for adoption of the Zoning Ordinance and Mr. Plummer <br />seconded the motion, which passed unanimously. <br /> <br />The Council moved to 9.A. and B. on the agenda. Mayor Morris <br />introduced for consideration adoption of an Ordinance on third and <br />final reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY'S ELECTRIC UTILITY TARIFFS TO INCREASE <br />THE RATES FOR CERTAIN CUSTOMER CLASSIFICATIONS; PROVIDING FOR <br />SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING <br />FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for adoption of the Ordinance on third and final <br />reading and Mr. Mooney seconded the motion. Mr. Plummer moved to <br />amend the Ordinance to attach a Revised Appendix Rate Schedule and <br />Mr. Moore seconded the motion, which passed unanimously. The <br />Council then voted unanimously for adoption of the Ordinance on <br />third and final reading. <br /> <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on third and final reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ESTABLISHING A FRANCHISE AGREEMENT BETWEEN THE CITY AND <br />THE BLUEBONNET ELECTRIC COOPERATIVE, INC. FOR THE PROVISION OF <br />ELECTRICAL SERVICE WITHIN A PORTION OF THE CITY FOR A PERIOD OF <br />TEN YEARS, AND THAT THE CITY OF SAN MARCOS SHALL RECEIVE A <br />QUARTERLY FRANCHISE FEE FOR SUCH USE, PROVIDING FOR <br />INDEMNIFICATION OF THE CITY OF SAN MARCOS, AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mr. Moore moved for adoption of the Ordinance on third and final <br />reading and Mr. Mooney seconded the motion. Mayor Morris moved <br />to amend the Ordinance on Page 4 as follows: in Section 9 to read, <br />". . . term of this Agreement an amount [deletion] annually equal to <br />three percent ll!l . . . ." "Provided, that if Bluebonnet. . . <br />Bluebonnet shall be obligated to pay that same percentage to the <br />City under this franchise agreement [deletion]." And to amend on <br />Page 6 as follows: Delete section 16 and renumber section 17 to <br />Section 16, and the new section 16 to read as follows, "Bluebonnet <br />shall have thirty (30) days. . . and being in force and effect from <br />and after July lL 1993 [deletion] and shall effectuate. . . .," and <br />Mr. Moore seconded the motion, which passed unanimously (Mr. Hart <br />present to vote on this item - 7:52 p.m.). The Council voted <br />unanimously for adoption of the Ordinance on third and final <br />reading. <br />
